حق بر محیط زیست و رسانه؛ پژوهشی درباره تعهدات مرتبط با رسانه در کنوانسیون‌های بین‌المللی محیط زیستی

حق بهره مندی از محیط زیست سالم در گفتمان حقوق بشر در زمره نسل سوم این حقوق قرار دارد. در اسناد بین‌المللی محیط زیستی متعددی به نقش رسانه بر آگاهی‌بخشی و مشارکت در فرآیند دسترسی به آموزش، مشارکت و اطلاع‌رسانی محیط زیستی پرداخته شده است. در این مقاله سعی شده است با روش تحلیلی و توصیفی با ارجاع ویژه به نقش رسانه در تضمین حق بر محیط زیست سالم به تعهدات رسانه ای و اطلاع‌رسانی محیط زیستی دولتها در اسناد و کنوانسیون های پایه محیط زیستی پرداخته شود. سوال اصلی این است چه نسبتی میان رسانه و ایفای تعهدات محیط زیستی بین‌المللی در تضمین و ارتقاء بعد حق بر اطلاع‌رسانی و مشارکت در تصمیم‌گیری های محیط زیستی وجود دارد. فرض اساسی این مقاله در پاسخ به پرسش اصلی این است که با بررسی و تحلیل برخی اسناد بین‌المللی محیط زیستی میتوان تعهداتی را در ارتباط با رسانه و محیط زیست شناسایی کرد. مهمترین یافته جدید این مقاله تبیین ارتباط میان حق بر محیط زیست و رسانه در چارچوب تعهدات بین‌المللی دولتها در کنوانسیون های بین‌المللی محیط زیستی است.

right to environment and media; a case study of obligations related to media in international environmental conventions

the right to benefit from a healthy environment is among the third generation of universal rights in the discourse of human rights. in several international environmental documents، the role of the media awareness and participation in the process of access to education، participation and environmental information has been discussed. in this article، it has been tried to deal with the media obligations and environmental information of the governments in the basic environmental documents and conventions with special reference to the role of the media in guaranteeing the right to a healthy environment with an analytical and descriptive method. the basic question is to survey what is the relationship between the media and the fulfillment of international environmental obligations in guaranteeing and promoting the right to information and participation in environmental decision-making. the basic hypothesis of this article in response to the main question is that، by carefully reading some international environmental documents، it is possible to identify obligations related to the media and the environment. the most important new finding of this article is the explanation of the relationship between the right to the environment and the media in the framework of international obligations of governments in international environmental conventions.
