تحریم های آمریکا علیه ایران از منظر عهدنامه مودت 1955 (با تاکید بر دیدگاه اندیشکده‌ها و رسانه‌های آمریکایی)

آمریکا از سال‌های اولیه انقلاب اسلامی علیرغم عهدنامه مودت 1955، اقدام به وضع تحریم‌های یک‌جانبه علیه ایران کرده است. این تحریم‌ها با گذشت زمان گسترده‌تر و شدیدتر شده، به نحوی که ایران در شرایط کنونی با تحریم‌های سنگینی مواجه بوده و این امر بر صادرات نفت و اقلام غیرنفتی راهبردی، انتقال پول و حتی واردات مواد غذایی و دارو تاثیر زیادی گذاشته است. لذا، پژوهش حاضر با استفاده از روش توصیفی-تحلیلی ضمن تبیین چارچوب نظری تحریم و مسئولیت دولت‌ها، به ‌نقد و بررسی رویکرد قهری آمریکا در اعمال تحریم‌های ‌یک‌جانبه علیه ایران با استفاده از مفاد عهدنامه مودت 1955 پرداخته است. نتایج تحقیق بیانگر این است که استناد مکرر دولت آمریکا و ایران به عهدنامه مودت در دعاوی مختلف میان دو کشور در دیوان بین‌المللی دادگستری (icj) به‌معنی قابلیت اعمال عهدنامه مذکور بر روابط دو کشور تا زمان خروج رسمی یکی از طرفین از آن است. لذا، تحریم‌های یک‌جانبه آمریکا مغایر عهدنامه مذکور مبنی بر روابط دوستانه تجاری و کنسولی دوطرفه است. در این راستا، رسانه‌های برون‌مرزی ایران به‌موازات ادامه رسیدگی به شکایت ایران علیه آمریکا در دیوان، می‌توانند با استفاده از ظرفیت‌های رسانه‌ای و گفتگو با کارشناسان حقوق بین‌الملل، غیرحقوقی بودن تحریم‌های یک‌جانبه آمریکا علیه ایران، نقض تعهدات بین‌المللی آمریکا و مسئولیت این کشور در این خصوص را برای افکار عمومی جهان تبیین و تشریح کنند.

the us sanctions against iran from the perspective of the 1955 treaty of amity(with an emphasis on the american think tanks and the media viewpoints)

since the early years of the islamic revolution, the united states has imposed unilateral sanctions against iran despite the treaty of amity (1955). these sanctions have become wider and more severe with the passage of time, so that iran is facing heavy sanctions in the current situation and this has greatly affected the export of oil and strategic non-oil items, money transfer, and even the import of food and medicine. therefore, the present research, by using the descriptive-analytical method, while explaining the theoretical framework of sanctions and the responsibility of governments, has criticized and investigated the coercive approach of the united states in applying unilateral sanctions against iran from the perspective of the treaty of amity (1955). the results of the research show that the repeated reference of the american and iranian governments to the treaty of amity in various lawsuits between the two countries in the international court of justice (icj) means that the aforementioned treaty can be applied to the relations between the two countries until the official withdrawal of one of the parties from it. therefore, the unilateral us sanctions are contrary to the aforementioned agreement based on friendly bilateral commercial and consular relations. in this regard, iran’s overseas media, in parallel with the continuation of the complaint against the united states in the court, can use their media capacities and talk with international law experts, while explaining the illegality of the sanctions against iran, the violation of the united states’ international obligations and it’s responsibility in this regard to the public opinion of the world.
