نقش اخبار جعلی رسانه‌ها در عملکرد دیوان بین‌المللی کیفری با تاکید بر پرونده کنیا

دیوان بین‌المللی کیفری به‌عنوان مهمترین مرجع قضایی بین‌المللی برای محاکمه جنایت‌کاران بین‌المللی محسوب می شود. این دیوان که حدود دو دهه از عمر آن می گذرد برای شناسایی توسط جامعه بین‌المللی و مردم جهان نیازمند استفاده از رسانه های ارتباط جمعی است. این در حالی است که نقش رسانه ها در شناسایی دیوان مزبور حکم شمشیر دو لبه دارد چراکه از یک‌ سو عملکرد مناسب رسانه ها می تواند در افزایش مشروعیت بین‌المللی این نهاد قضایی موثر باشد اما از سوی دیگر عملکرد نامناسب رسانه ها در قالب پخش اخبار دروغین در مورد این دیوان می تواند دستاوردهای این محکمه را که مدیون دهه ها تلاش برای تشکیل چنین محکمه ای بوده است، از بین ببرد. هدف این مقاله بررسی نقش اخبار جعلی و دروغین منتشر شده در رسانه ها بر عملکرد دیوان بین‌المللی کیفری با تاکید بر پرونده دولت کنیا در این دیوان است. نگارنده در این مقاله سعی دارد به این سوال پاسخ دهد که آیا رسانه ها و نشر اطلاعات جعلی توسط آنها می تواند بر عملکرد دیوان بین‌المللی کیفری تاثیرگذار باشد و آیا راهکارهایی برای خنثی نمودن نقش رسانه های منتشر کننده اطلاعات جعلی بر عملکرد دیوان بین‌المللی کیفری وجود دارد یا خیر؟ روش تحقیق در این مقاله، توصیفی- تحلیلی و شیوه جمع آوری اطلاعات، کتابخانه ای- اسنادی است. یافته های این پژوهش نشان می دهد که انتشار اخبار جعلی توسط رسانه ها می تواند بر عملکرد دیوان کیفری بین المللی تاثیر منفی داشته باشد ولی اگر دیوان سیاست رسانه ای باز و شفافی اتخاذ کند می تواند نقش اخبار جعلی را بر عملکرد خود خنثی کند و مانع کاهش اعتبار خود نزد افکار عمومی بین المللی شود. در نهایت هم پیشنهادهایی برای رسانه های برون‌مرزی صداوسیمای جمهوری اسلامی ایران ارائه شده است.

the role of media fake news in the functioning of the international criminal court with an emphasis on the kenya case

the international criminal court (icc) is the most important international judicial body for the trial of international criminals. this court, which has been around for two decades, needs to use the mass media to be recognized by the international community and the people of the world. the role of the media in identifying the aforementioned court is a double-edged sword; because, on the one hand, the proper functioning of the media can be effective in increasing the international legitimacy of this judicial body but on the other hand, the inappropriate performance of the media in the form of spreading false news about this court can destroy the achievements of this court, which is owed to decades of efforts to establish such a court. the purpose of this article is to examine the role of fake and false news published in the media on the performance of the icc, emphasizing the kenyan government’s case in this court. in this article, the author tries to answer the question whether the media and the publication of fake information by them can affect the performance of the icc and are there solutions to neutralize the role of the media that publishes fake news? the research method in this article is descriptive-analytical and the method of collecting information is library-documentary. the findings of this research show that the publication of fake news by the media can have a negative effect on the performance of the icc but if the court adopts an open and transparent media policy, it can neutralize the role of fake news on its performance and prevent its credibility in the eyes of international public opinion. finally, suggestions have been made for the international media of the islamic republic of iran.
