ترور شهید سپهبد سلیمانی از منظر قواعد حقوق بین‌الملل و حقوق ‌بشردوستانه (با تاکید بر رسالت رسانه‌های برون‌مرزی)

در تاریخ چهاردهم دی 1398 (3 ژانویه 2020)، سپهبد قاسم سلیمانی فرمانده سپاه قدس ایران، مهندس ابومهدی المهندس معاون الحشد‌الشعبی و کاروان همراه آنها، مورد حمله موشکی و ترور هدفمند ارتش آمریکا قرار گرفت. با توجه به اینکه ترورِ هدفمند شهید سپهبد سلیمانی، به‌عنوان فرمانده ارشد نظامی یک کشور در خاک کشور دیگر از سوی کشوری ثالث، نمونه بارز تروریسم دولتی محسوب می‌شود، بر این اساس، سوال مقاله این است که ترور این فرمانده ارشد نظامی ایران و جبهه مقاومت، از منظر قواعد حقوق بین‌الملل و حقوق ‌بشردوستانه چه وضعیتی دارد؟ برای رسیدن به پاسخ، پژوهش با روش تحقیق‌ توصیفی-تحلیلی و در چارچوب حقوق بین‌الملل بشردوستانه با گردآوری مدارک معتبر و موثق به طریق اسنادی و کتابخانه‌ای و مراجعه به مطالب منتشر شده در اندیشکده‌های معتبر بین‌المللی، به بررسی مسئله پرداخته است. یافته‌های پژوهش نشان می‌دهد اقدام آمریکایی‌ها در ترور فرمانده نظامی ایران و همراهانش، در تضاد عینی با منشور ملل متحد، ناقض بدیهی‌ترین اصول و قواعد حقوق بین‌الملل ازجمله اصول عدم‌مداخله، اصل حاکمیت دولت‌ها، اصل منع توسل به‌زور، اصل عدم تجاوز و اصل مصونیت نمایندگان دولت‌ها و در نهایت به‌عنوان جلوه‌ای از تروریسم دولتی و جنگ تجاوزکارانه علیه دو کشور ایران و عراق قلمداد می‌شود. در این میان، نهادهای حقوق بشری، سازمان ملل، اندیشکده‌های بین‌المللی و معتبر جهانی نیز اقدام دولت آمریکا را تجاوزکارانه، جنایت آشکار و نقض جدی حقوق بین‌الملل دانسته‌اند.

Assassination of Martyr Lieutenant General Soleimani from the Perspective of International Law and Humanitarian Rights (with an Emphasis on IRIB World Service Mission)

On January 3, 2020, during a targeted operation, Lieutenant General Qassem Soleimani, Commander of the Quds Force of Iran’s IRGC, Engineer Abu Mehdi, Deputy of Hashad alShaabi and their companions were martyred through a assassination by the US Army. Since the targeted assassination of a senior military commander of one country in another country by a third party is a totally bizarre and unprecedented act, the research question is as follows: How this targeted assassination is viewed from the perspective of international law and humanitarian rights? In order to find the answer, the research has studied the issue through descriptiveanalytical method by collecting valid and credible documents from libraries and also referring to the materials published in reliable international think tanks. The findings show that the US action in assassinating General Soleimani and his companions is in absolute contradiction with the UN Charter, violates the most obvious principles and rules of international law, including the principle of nonintervention, the principle of sovereignty, the principle of nonaggression, the principle of immunity of government representatives and ultimately as a manifestation of state terrorism and aggression against the two countries of Iran and Iraq. Meanwhile, Human Rights Institutions, United Nations, international and worldrenowned think tanks have called the US government’s action an aggression, a blatant crime, and a violation of international law.
