جنایت جنگی و جنایات علیه بشریت عربستان سعودی در یمن از منظر حقوق بین‌الملل

در 25 مارس 2015 ائتلافی متشکل از برخی دولت‌های عربی به رهبری عربستان سعودی، حملات هوایی خود را با نام عملیات توفان قاطعیت علیه یمن آغاز کردند. سعودی‌ها و ائتلاف تحت رهبری آنها به اهداف غیر نظامی در یمن حمله و ده‌ها هزار غیرنظامی از جمله کودکان و زنان را کشته و زخمی کرده‌اند؛ ممانعت از ارسال کمک‌های بشردوستانه صلیب سرخ جهانی، حمله به زیرساخت‌های غیر نظامی و همچنین استفاده از سلاح‌های ممنوعه علیه مردم یمن از جمله اقدام­های در حال وقوع در این کشور می‌باشد. در نوشتار پیش‌روبه روش توصیفی – تحلیلی با بهره‌گیری از مطالعات کتابخانه‌ای، مداخلۀ نظامی در یمن از منظر حقوق بین‌الملل و با واکاوی نقض احتمالی اصول حقوق منع توسل به زور، نقض حقوق بشردوستانه و ارتکاب جنایات ذاتاً بین‌المللی در یمن همچون جنایات جنگی و جنایات علیه بشریت، بررسی می‌شود. همچنین مسئولیت بین‌المللی مرتکبین و حامیان‌شان، علاوه بر مسئولیت کیفری عاملان و مباشران آن مطرح و راهکارهای رسانه‌ای توصیه  می‌گردد.

The War Crimes and Crimes against Humanity by Saudi Arabia in Yemen from International Law Perspective

In 25 Mars 2015 a coalition led by Saudi Arabia including some Arab States began its air attacks against Yemen under the name of Operation Decisive Storm. Saudis and their coalition attacked on civilian targets in Yemen and killed and wounded ten thousand of people including women and children. Preventing the transition of humanitarian aids by World Red Cross, bombardment of civilian infrastructures as well as using forbidden weapons against Yemeni people is the actions which taking place there. Using analyticaldescriptive method and librarian studies, this paper attempts to survey the military intervention in Yemen from international law perspective and looking at probable violation of Non use of force principle, violation of humanitarian law and committing international crimes in Yemen such as war crimes and crimes against humanity. Also, the international responsibility of perpetrators and their supporter in adding to criminal responsibility of them and their counselor has been discussed as well as media recommendations be suggested. This continuous and nonstop aggression is a serious threat against global peace and security, so need an immediate reaction by international community; specially, the Security Council that has the main responsibility to maintain the international peace and security should act according to its responsibility regarding Yemen.
