کشتی گریس وان که پس از این که 43 روز در توقیف بنا به حکم دیوان عالی جبل الطارق بود، متعاقبا پس از حکم آزادی که از سوی همین دیوان صادر شد، در قلمروی سرزمینی بریتانیا در دریای مدیترانه توقیف شده و در آخرین اقدام، ایالات متحده آمریکا درخواست صدور توقیف نفت کش ایرانی که از سوی نیروی دریایی بریتانیا در جبل الطارق به دلیل نقض تحریم های بین المللی بازداشت شده بود، نمود. این کشتی در 4 جولای 2023 میلادی از سوی نیروی دریایی بریتانیا به دلیل ظن به نقض تحریم های اتحادیه اروپایی علیه سوریه که متحد جمهوری اسلامی ایران است، توقیف گردید. ایالات متحده آمریکا از این رو، تلاش نموده است تا نسبت به توقیف کشتی گریس وان اقدام نماید که به این امر استناد کرده است که با نیروهای سپاه پاسداران انقلاب اسلامی که بر اساس قوانین کشور اخیر، در زمره سازمان های تروریستی خارجی قرار دارد؛ ارتباط دارد.

the act of impounding ships is a legal act that has always brought various debates with it, which is exclusive to commercial ships and government ships engaged in business and does not apply to non-commercial government ships and warships because this the ships are subject to their own legal system and are a manifestation of the sovereignty and independence of the flag-owning country. on july 13, 2018, the british armed forces, at the request of the united states government, arrested an iranian oil tanker known as ((grace one)) in the strait of gibraltar with this charge. who are suspected of violating european union sanctions against syria; they detained them for more than 14 days and their captain and crew chief, both of whom were indian nationals, were arrested in this connection. the main question of the current research is whether the seizure of the oil tanker grace one of the islamic republic of iran by britain has a legal source from the point of view of international law? the main hypothesis of the present research is that according to the international regulations governing the exercise of control by the coastal state, as well as the impossibility of unilateral sanctions against third countries, the seizure of the said ship does not have a source of legality in international law.
