مسئولیت مدنی ناشی از کاربرد سامانه های نظامی دریایی مبتنی بر هوش مصنوعی در مناطق مختلف دریایی با تاکید بر چالش ها و خلاءها

هوش مصنوعی با ظهور انقلاب چهارم صنعتی به ویژه در علوم نظامی دریایی به عنوان یک واقعیت مطرح شده است. سامانه های نظامی دریایی مبتنی بر هوش مصنوعی، کاربردهای مختلفی از جمع آوری داده ها تا محاسبه گری های نظامی و تصمیم گیری را برعهده دارند. هم چنین سامانه های هوش مصنوعی قابلیت کنترل از خود، تنظیم گری و اقدام خودکار نظامی را در موارد حملات دریایی افزایش داده اند. سامانه های هوش مصنوعی امروزه تقریبا در هر کاربرد نظامی دریایی مورد استفاده قرار می گیرند. با این حال، تمامی کاربردهای سامانه های نظامی دریایی مبتنی بر هوش مصنوعی نمی تواند مصون از ایراد بوده و از این رو، مباحث مربوط به مسئولیت مدنی ناشی از کاربرد این سامانه ها مطرح شده است. در همین راستا، چالش هایی مانند اعمال حاکمیت نیز مطرح می شود که بر طبق ماده 9 قانون مسئولیت مدنی 1339 از موارد استثنای مسئولیت مدنی می باشد. سوال اصلی که در این مقاله که به روش توصیفی تحلیلی صورت گرفته است، این می باشد که مسئولیت مدنی ناشی از کاربرد سامانه های نظامی دریایی مبتنی بر هوش مصنوعی در مناطق مختلف دریایی به چه صورت از منظر نظام حقوق ایران قابلبت تحلیل دارد؟ در پاسخ به این سوال بایستی گفت که دو دسته اعمال برای این سامانه ها قابل تصور است بدین معنا که در صورتی که در مقام اعمال حاکمیت باشند و خسارتی به اشخاص وارد آید، بر اساس ماده 9 قانون مسئولیت مدنی، مسئولیتی متوجه نیروهای مسلح دریایی نبوده و در صورت وجود اعمال تصدی گری، این مسئولیت مدنی قابلیت انتساب است.

artificial intelligence has emerged as a reality with the advent of the fourth industrial revolution, especially in naval military science. naval military systems based on artificial intelligence have various applications from data collection to military calculations and decision making. also, artificial intelligence systems have increased the capability of self-control, regulation and automatic military action in cases of naval attacks. artificial intelligence systems are used in almost every naval application today. however, all the applications of naval military systems based on artificial intelligence cannot be immune from problems, and therefore, issues related to civil liability arising from the use of these systems have been raised. in this regard, challenges such as the exercise of sovereignty are also raised, which according to article 9 of the civil liability law of 1339 is one of the exceptions to civil liability. the main question in this article, which has been done in a descriptive-analytical way, is that the civil liability resulting from the use of artificial intelligence-based naval military systems in different maritime areas can be analyzed from the perspective of iran's legal system. in response to this question, it should be said that two categories of actions are conceivable for these systems, meaning that if they are in the position of exercising sovereignty and damage is caused to individuals, based on article 9 of the civil liability law, there is no responsibility towards the naval armed forces. and if there are tenure practices, this civil responsibility is assignable
