بهره‌مندی محکومان از حق آموزش؛ راهبرد پیشگیری از تکرار جرم

انسان در هر مکان و زمان و بدون هرگونه تبعیض به‌صورت برابر مستحق بهره‌مندی از حقوق بشری خود به‌مثابه حقوق ذاتی و انفکاک‌ناپذیر می‌باشد. حقوق بشر انسان را تنها به علت خصیصه انسان بودن دارای حقوق و آزادی می‌شناسد که ازجمله این حقوق حق آموزش می‌باشد. آموزش امروزه رکن اساسی ترقی و پیشرفت جوامع بشری قلمداد می‌گردد و به‌عنوان یکی از حقوق بنیادین هر فرد در جامعه است خواه آن فرد بزهکار یا غیر بزهکار باشد. هدف از پژوهش بررسی مبانی و همچنین خاستگاه و تحولات بهره‌مندی محکومان از حق آموزش و تاثیر آن در پیشگیری از تکرار جرم است. پژوهش حاضر با استفاده از اسناد و منابع کتابخانه‌ای و به روش توصیفی و تحلیلی نگارش یافته است. یافته‌ها و نتایج پژوهش حاکی از این است که برخورداری از حق آموزش در جهت اصلاح و تربیت محکومان امری اساسی و حیاتی برای اصلاح و تربیت بزهکاران است. بر مبنای نظریات جرم‌شناختی بزهکاران در فرایند جامعه‌پذیری و بازسازگاری اجتماعی که از طریق آموزش به آنان منتقل می‌شود می‌آموزند که در جامعه چگونه رفتار نمایند و هنجارها و ارزش‌های اجتماعی را محترم بشمارند و از سویی نیز از تکرار جرم در جامعه پیشگیری می‌شود.

the convicts’ right to enjoy an education; a strategy to prevent recidivism

humans are equally entitled to benefit from their human rights as inherent and inalienable rights in any place and time without any discrimination. human rights recognize mankind as having rights and freedoms by the mere fact of being a human being, and which includes the right to enjoy education. today, education is considered as the foundation of progress and development of human societies and is one of the fundamental rights of every person in society, irrespective of whether he is a criminal or not. the purpose of this research is to examine the foundation as well as the origin and developments of convicts benefiting from the right to education and its impact on prevention of recidivism. the present research has been carried out, using documents and library sources and a descriptive and analytical method. the findings and results of the research indicate that enjoying the right to education is fundamental to attain rehabilitation and character building of convicts. based on criminological theories, education helps criminals learn how to behave in society and respect social norms and values in the process of socialization and social reintegration, and on therefore helps to prevent recidivism.
