جنبش ھای قانون اساسی گرایی در اروپای دوره قرون وسطی

در مفهوم کلی، «قانون اساسی گرایی» حرکت به سوی اقتدار و حاکمیت محدود و تفکیک شده براساس قواعد و نهادهای الزام آور است. تحرکی که از غرب اروپا شروع و سپس در کل جهان خود را نمایان ساخته است. امروزه حاکمیت مبتنی بر قانون اساسی از صفات رژیم‌های لیبرال دموکرات می‌باشد به‌طوری که تلاش‌های صورت گرفته در این عرصه چه به صورت نهادینه و چه به شکل اتفاقی در شکل‌گیری آن در جهان نقش داشته است. حفاظت از حقوق و آزادی‌ها در مقابل اقتدار حاکم توسط مبانی حقوقی از آثار مهم قانون اساسی‌گرایی و جنبش‌های صورت گرفته در این عرصه می‌باشد. هدف از مطالعه جنبش‌های قانون اساسی‌گرایی در اروپای قرون وسطی، تبیین ریشه‌های این تفکر و همچنین نتایجی می‌باشد که از تعاملات و تضاد‌های حاکمان با کلیساها و تفکرات مدرن با سنتی به‌دست آمده است، که منجر به ظهور اشکالی جدید از حاکمیت و اقتدار در بطن سیستم‌های سیاسی کشورهای مختلف در جهان شده است. این مقاله تئوری فکری و نهادهای حاکمیت مبتنی بر قانون اساسی و جنبش‌های قانون اساسی‌گرایی در اروپای قرون وسطی را با نوع نظری و روش توصیفی و به صورت کیفی، مورد مطالعه قرار می‌دهد.

Pro-Constitutionalism Movements in medieval Europe

In its general sense, &proconstitutionalism& is movement towards limited and separated authority and sovereignty based on binding rules and institutions.This movement started in Western Europe and then spread throughout the world.Today, sovereignty based on constitutional is one of the characteristics of liberal democratic regimes, in such a way that the efforts made in this field, both institutionally and accidentally, have played a role in its formation in the world.The preservation of rights and freedoms against the ruling authority through legal foundations is one of the important effects of constitutionalism and movements in its support in this field.The purpose of the present study concerning constitutional movements in medieval Europe is to delineate the roots of this school of thought as well as the consequences of interactions and conflicts between the rulers and the Church and between modern and traditional thought, which led to the emergence of new forms of sovereignty and authority in the heart of the political systems of different countries in the world.This article studies the intellectual theory, sovereign institutions based on a constitution and constitutional movements in medieval Europe using a theoretical, descriptive and qualitative method.
