پیش فروش ساختمان به مثابه بیع مال معین اعتباری

حقوق‌دانان ماهیت‌های مختلفی برای قراردادهای پیش فروش به دلیل موجود نبودن مبیع در زمان عقد، قائل شده‌اند. در این تحقیق مفهوم پیش‌فروش و ماهیت این قرارداد بر اساس قصد متعاملین مورد بررسی قرار گرفت و نظریه «بیع مال اعتباری» ارائه گردید که به ضمیمه آن شرط ضمن عقد احداث ساختمان وجود دارد. به موجب این نظریه، قرارداد پیش فروش عبارت است از بیع عین معین آپارتمان ساخته نشده به‌علاوه شرط عینیت فیزیکی بخشیدن به آن (احداث ساختمان). رابطه عقد و شرط مذکور، مورد تحلیل قرار گرفت و در نتیجه معلوم شد آثار این قرارداد با متعاملین و عرف جاری مطابقت دارد و نیازهای جامعه امروزی را برآورده می‌سازد از آن جمله تملک بی‌درنگ خریدار به آنچه وجود دارد و بعداً کمال می‌یابد.

Sale of intangible property Theory in pre-sale of the building

Abstract: Jurists have attributed different natures to presale contracts due to the fact that a sold property does not exist at the time the contract is entered into.In this study, the concept and nature of presale are examined based on the intentions of the contractors and the theory of &an abstract sense of sale of property& in which there is a condition concerning construction of the building is suggested. According to this theory, a presale contract is the sale of a specific unbuilt apartment, as well as a condition concerning giving concrete form to it (construction of a building).The relationship between the contract and the aforementioned condition is analyzed. As a result, it becomes clear that the effects of this contract are in accordance with the intentions of the parties and current customs, meeting the needs of today’s society, including the immediate ownership of the purchaser over what already exists and will be completed later.
