تحلیل ساختار حقوقی نهاد های خود انتظام در بازار سرمایه‌ ایران با استفاده از نظام حقوقی آمریکا

در مقاله حاضر اهتمام بر این بوده است تا با تاکید بر قوانین و رویه عملی، ساختار حقوقی نهاد‌های خودانتظام در بازار سرمایه ایران و آمریکا مورد بررسی قرار گیرد و این موضوع در ایران وآمریکا (که به نوعی مبدح روش خود انتظامی برای تنظیم مقررات است)، تبیین شود. برای نیل به این هدف، بحث را از مهم ترین زوایا مورد تحلیل قرار دادیم؛ از این رو، در این مقاله منشا قانونی نهادهای خودانتظام، ماهیت این نهاد‌ها و نحوه تشکیل، تعلیق و انحلال آنها، اختیارات مقررات‌گذاری، حل و فصل اختلافات و مراجع رسیدگی به تخلفات (انضباطی و کیفری) اعضا را به صورت تطبیقی با نظام حقوقی آمریکا بررسی کردیم و افزون بر تفصیل عناوین یاد شده، این نتیجه به دست آمد که نظام حقوقی ایران و آمریکا در این زمینه به غیر از برخی تفاوت‌های جزئی، مشابه یکدیگر هستند.

Analyzing the legal structure of self-governing institutions in the Iranian capital market using the US legal system

In this article, with the emphasis on laws and practical procedures, the legal structure of self-regulatory institutions in the capital markets of Iran and the United States has been examined, and this issue in Iran and the United States (which is a kind of self-regulatory method of regulation) , To be explained. To achieve this goal, we analyzed the discussion from the most important angles; Therefore, in this article, the legal origin of self-regulatory institutions, the nature of these institutions and how to form, suspend and dissolve them, regulatory powers, dispute resolution and violations (disciplinary and criminal) authorities of members in accordance with the US legal system We examined and in addition to detailing the above topics, it was concluded that the legal system of Iran and the United States in this area, except for some minor differences, are similar to each other.
