نگرشی نو به حجیت ظن معتبر با تاکید بر آراء امام خمینی(ره)

حجیت عقلانی و کشف مناط آن در ظنون از ابتکاراتی است که در عصر جدید زمینه‌ی بازسازی علم اصول را بر این پایه هویدا می‌سازد. عقل و خرد جمعی با برخورداری از امتیاز تائید شارع در هر دوره‌ای می‌تواند زمینه شکوفایی بیش از پیش قرائت بشری از دین را فراهم آورد. در این پژوهش پس از باز تعریف مفاهیمی بنیادین همچون «عقل»، «حجیت»، «ظن» و «علم» و بیان ارزش معرفت‌شناختی ظنون عقلانی به عنوان پیش فرضی اثر بخش در حل محذورات، قول به اعتبار ظن معتبر با ادله عقلانی، این امکان فراهم آمده است که به حجیت ذاتی ظن، باور یابیم و ضمن بررسی ادله‌‌ی عقلایی، از این حقیقت پرده برداشته شود که آیات و اقتضائات عقلی، بر خلاف آنچه پنداشته می‌شود، نافی حجیت ظن عقلایی نیست و ظن عقلایی، بالطبع حجت است. امام خمینی(ره) نیز با بحث از ظنون تحت عنوان پیشنهادی، در عدم امتناع تعبد به امارات، نافی استدلال و برهان در تعبد وقوعی به امارات گردیده‌اند و به دلیل پذیرش این مبنا توسط عقلا امکان امتناع را در آن وارد نمی‌دانند و بر پذیرش مبنای ظن عقلائی تاکید می‌ورزند.

A new approach to the validity of valid suspicion with an approach to Imam Khomeini’s views

In this study, after redefining basic concepts such as intellect, authority, suspicion and science and expressing the epistemological value of rational suspicion as an effective presupposition in solving limitations, the promise of valid suspicion with rational arguments, It is possible to believe in the inherent authority of suspicion and, while examining rational arguments, to expose the fact that verses and rational requirements, contrary to what is assumed, do not negate the authority of rational suspicion and rational suspicion. Of course, it is an argument. Imam Khomeini (ra) by discussing the suspicion under the proposed title, in not refusing to worship the UAE, has rejected the argument in the incident to the UAE and because of the acceptance of this basis by the wise do not consider the possibility of refusal in it. And emphasize acceptance on the basis of rational suspicion.
