نقد و بررسی دیدگاه‌های مختلف در مورد نسبت بین عام و مطلق در مذاهب خمسه

نسبت بین عام و مطلق از مسائلی است که میان علمای اصول، اختلاف‌نظر وسیعی وجود دارد و همواره معیارهای تمایزبخش این دو مفهوم بخش قابل توجهی از مباحث اصول فقه در باب عام و خاص را دربرگرفته است. این اختلاف دامنه‌ای وسیعی از علوم منطق، فلسفه، ادبیات عرب و اصول فقه را دربرگرفته است، لذا مقتضی است که پژوهشی در این رابطه صورت گیرد. حاصل این پژوهش که با روش تحلیلی – توصیفی با استناد به منابع کتابخانه‌ای انجام گرفته است، این است که به‌اتفاق، دانشمندان قائل هستند که عام دلالت وضعی بر شمول دارد؛ لکن در مدلول مطلق اختلاف‌نظر دارند و پنچ نگرش عمده در این زمینه مطرح کرده‌اند: 1 برخی قائل هستند مدلول مطلق ماهیت به‌شرط لا است؛ 2 برخی دیگر مدلول آن را نکره در سیاق اثبات دانسته‌اند؛ 3 برخی مدلول مطلق را، طبیعت و ذات المعنی دانسته‌اند و نقش مقدمات حکمت اخذالقیود دانسته‌اند؛ 4 برخی مدلول مطلق را، طبیعت و ذات المعنی دانسته‌اند، لکن نقش مقدمات حکمت اخذالقیود دانسته‌اند؛ 5 برخی بر این عقیده هستند لفظی برای مطلق و مقید وضع نشده است. به نظر می‌رسد از لحاظ دقت‌های عقلی قول به اینکه اطلاق ناشی از وضع نیست و مقدمات حکمت به‌نحو رفع القیود است، متین است، ولی از آن جهت که در وضع الفاظ این گونه دقت‌های عقلی شانی ندارد؛ لذا قول به طبیعت لابشرط موجه به‌نظر می‌رسد و انتقادهای واردشده بر این قول به جهات متعدد ضعیف است.

The relationship of the general and absolute is one of the issues that there is a lot of disagreement among the Scholars of Islamic jurisprudence. they agree unanimously that the general implies assignationally inclusion; But in relation to absolute assignated there is different opinions.Sunni and shia scholars believe that the absolute is due to the assignation; but the later Shia scholars recognize that the term is not the case.The former is becoming two groups. Some scholars have introduced the absolute assigned an indefinite word in the manner of proof and others have introduced it a quiddity without a condition and they who do not consider it due to assignation believe that the term indicate nature; Without an absolute be a restriction to an assignated, But they have disagreed on the role of the basics of wisdom. The famous opinion believes that the role of the basics of wisdom is to obtain restrictions, but the Imam and his subjects believe that the role of the basics of wisdom is to eliminate restrictions. From these views, it seems that the Imam’s view that expresses: absolute indicates natures and that’s the reason for removing the basics of wisdom is more justified.
