ولایت قیم بر اموال صغیر،مجنون وسفیه در فقه مذاهب اسلامی

زمینه وهدف:صغیرومجنون،به علت ناتوانی دراداره اموالشان از راه‌هایی موردحمایت قرار گرفته‌اند،آنها ازتصرف دراموال و حقوق مالی خود ممنوع هستند،افرادی چون پدر،جد پدری، وصی آن دو،وحاکم شرع بعنوان قیم بر آنها ولایت داشته و در امور مالی آنان حق تصرف دارند. حاکم شرع قیم است و شرعا نیزمی تواند، شخصی را به عنوان قیم برای این کارمنصوب کند. در فقه مذاهب اسلامی توجه خاصی به امور صغیر ومجنون و در برخی از آیات قران کریم و روایات سرپرستی و امور مالی کودک ومجنون تبیین گردیده است. هدف از این نوشتارشناخت موارد اشتراک واختلاف مذاهب پنجگانه اسلامی درنحوه وچگونگی ولایت قیم بر اموال صغیر ومجنون است وشرایط تصرفات او.روش:این تحقیق به روش توصیفی تحلیلی صورت پذیرفته، ادله، مبانی وشرایط ولایت قیم وقیمومت صغیر ومجنون از دیدگاه امامیه واهل سنت مورد بررسی قرار گرفته است. نتیجه گیری: به اتفاق تمام مذاهب پنج‌گانه قیم بر شخص صغیر، سفیه ومجنون ولایت دارد. اما در زمان ولایت داشتن وی بر آنان اختلاف نظر وجود دارد. از نظر امامیه، ولایت قیم وحاکم به عنوان قیم بر صغیر ومجنون زمانی است که آنان، پدر، جد پدری و وصی نداشته باشند و شخصی که بعد از بلوغ دچار جنون شده باشد، ولایت بر او با قیم است.
