حکم اولیه تعدد زوجات از منظر فقه امامیه

مسئله تعدد زوجات از جمله احکام امضایی است که در نظام حقوقی اسلام مورد شناسایی قرارگرفته است. پدیده چندهمسری از مباحثی است که در قرن اخیر بسیار مورد توجه اندیشمندان اجتماعی قرار گرفته است نکته درخور تامل در این تبیین‌ها، اتخاذ سرسختانه موضع دفاع یا مخالفت با چندهمسری است. هدف پژوهش حاضر، بررسی فقهی حکم اولیه تعدد زوجات است. بدین منظور منابع دست اول فقهی به دقت نقد و بررسی گردید. یافته ها به روش کتابخانه ای و توصیفی تحلیلی مقایسه و تحلیل گردید. و نتایح ذیل به دست آمد: اگرچه اصل جواز تعدد زوجات براساس ادله قطعی مورد اجماع و اتفاق همه مذاهب اسلامی است، ولی پرسش جدی درباره خصوصیت این حکم وجود دارد. مشهور میان متقدمین ادعای اجماع بر جواز تعدد زوجات و استحباب اکتفای به یک زن در اصل شرع جدای از حیثیات افراد و شرایط متفاوت ‌شده است. بنابراین حکم فی نفسه تعدد زوجات از نظر شرع اباحه می باشد و با عروض شرایطی تعدد زوجات مستحب، مکروه و احیانا حرام می شود.

The initial ruling of polygamy from the perspective of Imami jurisprudence

The issue of polygamy is one of the signature rulings that has been recognized in the Islamic legal system. The phenomenon of polygamy is one of the topics that has received a lot of attention from social thinkers in the last century. The purpose of the present study is to study the jurisprudence of the initial ruling on polygamy. For this purpose, firsthand jurisprudential sources were carefully reviewed. Findings were compared and analyzed by library and descriptiveanalytical methods. And the following results were obtained: Although the principle of permitting polygamy is based on conclusive evidence agreed upon by all Islamic religions, but there is a serious question about the specificity of this ruling. Popular among the forerunners is the claim of consensus on the permissibility of polygamy and the acceptance of contentment with a woman in the principle of Shari’a apart from the status of individuals and different circumstances. Therefore, the ruling on polygamy in itself is abaha according to the Shari’a, and with the proposition of conditions, polygamy is recommended, disliked, and possibly forbidden.
