شاخصه‌های فقه ملا خلیل سعرتی از خلال کتاب «محصول المواهب الاحدیه فی الخصائص و الشمائل الاحمدیه»

ملا خلیل سعرتی از دانشمندان برجسته و مشهور در عرصه علم و تقوی است که دارای آثار علمی متعددی در علوم عقلی و نقلی می‌باشد آثار وی در علوم مختلف بیش از چهل تالیف است. از شاخصه‌های اصلی تالیفات وی می‌توان به مواردی چون: اخلاص، ازخودگذشتگی، انسجام و اتقان علمی در راستای خدمت به دین و همنوعان و سرزمینش یاد کرد. از حیث علمی نیز آثار وی بیانگر گستره علم و یافته و نکته سنجی وی در زمینه فقه می باشد. پژوهش حاضر در صدد آشکار ساختن جایگاه علمی این عالم فرزانه در این زمینه علمی و چگونگی به‌کارگیری علوم مختلف در راه رسیدن به فتوای دقیق و حکم صحیح و نگاه عمیق به مسائل فقه اسلامی از لابه لای آراء و اندیشه‌های وی در کتاب «محصول المواهب الاحدیه فی الخصائص و الشمائل الاحمدیه» است که کتاب اخیر را در بیان خصائص و شمائل پیامبر(ص) تحریر نموده است. لازم به ذکر است که تسلط او بر علوم مختلف موجب شده تا در بیان نکات علمی در این کتاب، به مسائل مختلفی از علوم گوناگون اشاره کند. بیان آراء فقهی در مسائل مختلف از جنبه‌های بارز این کتاب است که نویسنده برای استفاده بیشتر خوانندگان و بیان جایگاه والای شریعت و فقه در میان مطالب کتاب بیان کرده است. پژوهش حاضر با روش توصیفی تحلیلی در صدد آن است که جایگاه فقهی شیخ سعرتی را آشکار سازد و برای رسیدن به این هدف، بحث در سه محور، بیان می‌شود: ترحیجات فقهی وی در زمینه‌های مختلف، چگونگی ارزیابی و نقد دیدگاه‌های فقهی، جمع متون شرعی متعارض ذکر شده در سنت نبوی که دارای جنبه عملی و رویکرد فقهی می‌باشد. علاوه بر این‌ها، به دیدگاه‌ها و توضیحات دقیق وی در مسائل مختلف فقهی اشاره شده است تا جایگاه وی در بیان علم اصول و بیان مسائل اصولی نیز مشخص شود و در پایان شیوه انطباق چارچوب‌های فقهی بر مسائل مستحدث و مسائل فقهی مختلف بیان گردد.

The jurisprudence of Sheikh AlMulla Khalil AlSaarty through his book: “The Crop of Talents, Shoes in the Characteristics and Characteristics of Ahmadiyyat”

A prominent, wellknown scholar in science and piety, Mullah Khalil Siirti has more than forty works in intellectual and transmitted science. His publications are characterized mainly by sincerity, sacrifice, coherence, and scientific firmness, which he has pursued to serve his religion, fellowmen, and land. Scientifically, his works indicate his extensive knowledge, prosperity, and rigor in the area of jurisprudence. The present research seeks to cast light on the scientific position of this erudite scholar in this area of science and his methods of application of different branches of science to be able to adopt accurate juridical attitudes, correct judgments, and profound perspectives with regard to issues in Islamic jurisprudence. For this purpose, his views and thoughts are extracted from his book Mahsul alMawahib alAhdiyah fi alKhasais wa alShamail alAhmadiyah, recently authored to enumerate the Islamic Prophet’s (PBUH) virtues and merit. It should be noted that Siirti’s mastery over different branches of science has led him to address a range of issues from various disciplines in his statement of scientific points in the book. Another significant aspect of the book involves the expression of views on different topics based on jurisprudence, included here and there to further the reader’s benefit and indicate the high position of Islamic law and jurisprudence. The present descriptiveanalytical research seeks to reveal Sheikh Siirti’s position in jurisprudence. For that purpose, discussion is made along three lines: his preferences in application of jurisprudence to different areas, his methods of assessment and criticism of the perspectives in jurisprudence, and his collection of contrastive religious text referred to on the Prophet’s practices with scientific aspects and jurisprudence approaches. Furthermore, his attitudes toward and precise accounts of different issues concerning jurisprudence are addressed here to clarify his position in the presentation of the principles of jurisprudence and fundamental issues therein.
