مدلول عقل و کارکردهای آن در اصول فقه اهل سنت

از ابتدای تاریخ اجتهاد، نقش عقل در استنباط احکام، موضوعی چالش برانگیز بوده و هست. در میان موافقان و مخالفانِ نقش عقل در فرآیند استنباط، برخی از علمای اصولی اهل سنت توانسته‌اند به دور از افراط و تفریط، نقشی کاربردی برای آن بیابند و بدون عنوان کردن بخشی مستقل برای آن در کتب و مباحث خود، از آن به عنوان ابزاری مفید استفاده کنند. در کشاکش نقش حداقلی یا حداکثری عقل، گرچه هیچگاه به عقل آزادی تصمیمگیری داده نشده است؛ اما نقش آن در به کاربردن کتاب و سنت و اجماع و قیاس شرعی و غیره قابل انکار نیست. این تحقیق به صورت تحلیلی و با استفاده از منابع کتابخانه‌ای به بازخوانی نقش عقل در اصول فقه اهل سنت در اجتهاد پرداخته و به این نتیجه رسیده است که بیشترین نقش عقل، در تشخیص برائت اصلی و فهم مقاصد کلی تشریع و عملیات قیاس و تطبیق احکام در جامعه است.

The meant and functions of mind in the Principles of Sunni jurisprudence

An important and challenging issue from the beginning of the history of Ijtihad is the role of mind in the inference of religious judgments. Some scholars in the Sunni have been able to find a useful role for it, far from excessive and worthless among the advocates and opponents, the maximal and minimal role of mind in the process of inference and Use mind as a useful tool without putting up an independent part for it in their books and discussions. Different roles of mind cannot be denied in the inference and understanding of religious purposes and religious comparison, although it has never been given free decisionmaking. This research is conducted analytically using library resources to review the role of reason in ijtihad based on the principles of Sunni jurisprudence and the result is that the greatest role of mind is in identifying the main being and understanding the general goals of the religion and comparative works and the implementation of religious laws within the community.
