ﺑﺮرﺳﯽ ﺟﺎﯾﮕﺎه ﺣﻘﻮﻗﯽ وﻓﺎداری و ﺧﯿﺎﻧﺖ زوﺟﯿﻦ از ﻣﻨﻈﺮ ﺣﻘﻮق اﯾﺮان و اﻧﮕﻠﯿﺲ

نقش مهم خانواده در اجتماع و تاثیر متقابل اجتماع و خانواده بر یکدیگر، استحکام و دوام نهاد مذکور از اهمیت زیادی برخوردار است، لذا بعد از انعقاد نکاح حقوق و تکالیفی برای زوجین ایجاد می‌شود و مسئولیت هایی اخلاقی و قانونی دارند. استحکام نهاد خانواده به پایبندی و وفاداری زوجین وابسته است و عدم وفاداری و خیانت یکی از چالش ها و آسیب هایی است که سبب از هم گسیختگی و ویرانی این نهاد مقدس می شود لذا با توجه به اهمیت وفاداری و عدم خیانت و نقش تعیین کننده آنها در استحکام و تقویت بنیان های خانواده پژوهش حاضر که به روش توصیفی تحلیلی می باشد و با هدف بررسی جایگاه حقوقی وفاداری و خیانت زوجین از منظر حقوق ایران و انگلیس انجام شده است. براساس نتایج تحقیق ضمانت اجرای نقض وفاداری زوجین در حقوق ایران نسبت به حقوق انگلیس وسیع تر است اما در حقوق ایران ضمانت اجراهای مدنی و کیفری در نظر گرفته شده و سوء معاشرت و خیانت زوج می‌تواند مستند درخواست طلاق زوجه قرار گیرد، و بی وفاداری زوجه سبب محرومیت او از پرداخت نفقه نیز می‌شود. در حقوق انگلستان در ابتدا عدم وفاداری و خیانت زوجین دارای ضمانت اجرای کیفری و مدنی بود و نیز می توانست مستند درخواست طلاق قرار گیرد ولی با اصلاح قوانین به تدریج عدم وفاداری و خیانت تمامی آثار حقوقی خود را از دست داده و به نظر می‌رسد مقنن انگلیس با بی توجهی به عدم وفاداری و خیانت زوجین در راستای انحلال خانواده قدم برداشته است.

investigating the legal status of marital fidelity and betrayal fromthe perspective of iranian and british law

considering the important role of the family in the society and the mutual influence of the society and the family on each other, the strength and durability of the said institution is of great importance, therefore, after the conclusion of marriage, rights and duties are created for the couple and they have moral and legal responsibilities. the strength of the family institution depends on the adherence and loyalty of the couple, and lack of loyalty and betrayal is one of the challenges and damages that cause the disintegration and destruction of this sacred institution, therefore, considering the importance of loyalty and non-faithfulness and their decisive role in the strength and strengthening of the foundations of the family. the present study, which is a descriptive analysis method, was carried out with the aim of investigating the legal position of marital fidelity and infidelity from the perspective of iranian and british law. based on the results of the research, the implementation of the violation of marital fidelity in iranian law is compared to british law. it is more detailed and wider, while in iranian laws, civil and criminal enforcements are considered for violating the fidelity of spouses, and misbehavior and infidelity of the spouse can be documented in the divorce request of the wife, and the unfaithfulness of the wife also causes her to be deprived of paying alimony. in english law, in the beginning, unfaithfulness and infidelity of spouses had the guarantee of criminal and civil enforcement, and it could also be documented as a divorce request, but with the amendment of the laws, unfaithfulness and infidelity has gradually lost all its legal effects and it seems it seems that the british legislator has taken a step towards the dissolution of the family by ignoring the lack of fidelity and betrayal of couples.
