قاعده‌ی عدم شرطیة البلوغ فی الاحکام الوضعیة در فقه، با رویکردی برنظر امام خمینی

این پژوهش به شیوه ی توصیفی تحلیلی، بر آن است تا اثبات کند بلوغ، در احکام وضعی شرط نیست که مفاد قاعده است. در این زمینه، به ادله‌ی اثبات آن، اعم از عمومات و اطلاقات، اجماع و سیره‌ی متشرعه و عقلا با رویکردی بر نظر امام خمینی (ره) پرداخته و این آرا را بررسی کرده است. حکم وضعی، حکمی‌‌است که مستقیماً به فعل و رفتار مکلف ارتباط ندارد، بلکه وضعیت خاصی را مقرر می‌کند که در رفتار انسان، به نحو غیرمستقیم، تاثیر می‌گذارد. عمومات و اطلاقات احکام، شامل صبی و نابالغ می‌شوند و این موارد تخصیص نخورده‌اند و مقید به بالغین نیستند و به بالغین انصراف ندارند. احکام تکلیفی الزامی ‌‌به بلوغ تخصیص خورده‌اند؛ اما احکام مستحب و احکام وضعی، تخصیصی ندارند و از دیدگاه عقلی و شرعی، مانعی برای شمول آنها درباره ی کودکان وجود ندارد. نظریه ی مختار نویسندگان این است که در احکام وضعی، بلوغ شرط نیست و قاعده، مبتنی بر دلایل استواری است.

The rule of non-conditionality of maturity in the rules of position in jurisprudence, with an approach according to Imam Khomeini

This research, in a descriptiveanalytical way, aims to prove that maturity is not a condition in situational judgments, which is the provisions of the rule. In this regard, he has examined the arguments for proving it, including generalities and applications, consensus, and the behavior of the legislators and the wise, with an approach based on the opinion of Imam Khomeini (ra) and has examined these opinions. A situational sentence is a sentence that is not directly related to the obligatory act and behavior, but determines a specific situation that indirectly affects human behavior. The generalities and applications of the rulings include the minor and the immature, and these cases are not assigned and are not restricted to adults and do not apply to adults. Mandatory mandatory sentences are assigned to puberty; However, the mustahab and situational rulings are not specific, and from a rational and religious point of view, there is no obstacle to their inclusion in the case of children. The authors’ autonomous theory is that in situational judgments, maturity is not a condition and the rule is based on solid reasons.
