حدود عسر و حرج در پزشکی از منظر فقه اسلامی

طبابت از ضروریات زندگی اجتماعی است و امر سلامت و جان انسان‌ها پیوسته یکی از دغدغه‌های مهم جوامع بشری است. انقلابی که تحقیقات علمی‌و اکتشافات جدید پزشکی در زمینه علم پزشکی به وجود آورده سوالات بیشماری را مطرح ساخته که فقهای اسلام نمی‌توانند درباره آنها سکوت اختیار کنند. از آن جهت که فقه پیوند عمیقی با زندگی انسان دارد، نتایج بحث و تحقیقات درباره این سوالات، در زندگی انسان‌ها موثر است. بنابراین بر علما و فقهای اسلام است که احکام این مسائل نو ظهور را که در زندگی انسان‌ها تاثیر گذارنداز لابه لای نصوص و قواعد شرعی بیرون کشیده و حکم الهی را در خصوص آن‌ها بیان کنند. بر این اساس با تکیه بر قواعد فقه می‌توان بسیاری از معضلات موجود در علم پزشکی را حل و فصل نمود و راه حل معتبر قابل قبول شرعی را پیش روی پزشکان متخصص متعهد قرار داد تا با استناد به ادله شرعی و با اطمینان خاطر به بررسی مصادیق موضوعات مشکل پرداخته و وجه شرعی آن را پیدا کنند و بدین ترتیب فقاهت و طبابت را هم دوش یکدیگر به پیش ببریم. در پژوهش حاضر برآنیم که نقش و تاثیر قاعده نفی عسروحرج بر حل مسائل نو پیدا در علم پزشکی و کارآمدی آن را تبیین نماییم.

Limits of difficulty in medicine from the perspective of Islamic jurisprudence

Medicine is one of the necessities of social life and the health and lives of human beings are constantly one of the important concerns of human societies. The revolution that has brought about scientific research and new medical discoveries in the field of medical science has raised countless questions that Islamic jurists cannot remain silent about. Because jurisprudence has a deep connection with human life, the results of discussion and research on these questions are effective in human life. Therefore, it is up to the scholars and jurists of Islam to take the rulings of these emerging issues that affect the lives of human beings out of the texts and rules of Sharia and to express the divine ruling on them. Based on this, by relying on the rules of jurisprudence, many problems in medical science can be resolved and a valid and acceptable Shari’a solution can be presented to specialized physicians to rely on Shari’a arguments and confidently examine examples of issues. Let them solve the problem and find its religious aspect, and in this way, we can carry out jurisprudence and medicine together. In the present study, we intend to explain the role and effect of the rule of negation of embarrassment on solving new problems in medical science and its efficiency.
