نهاد مطلوب نظارت عملیاتی بر طرح‏‌های تملک دارایی‏‌های سرمایه‌‏ای دولت در پرتو تحلیل اقتصادی حقوق و بایسته‌‏های حقوقی

از مولفه‌‏های حکمرانی خوب، کارآمدی و کارایی دولت، ازجمله سرمایه‌‏گذاری دولت در طرح‌های تملّک دارایی‏‌های سرمایه‏‌ای است که می‌‏تواند در قواعد حقوقی نیز، ظهور یابد و دستیابی به این مهم، ازطریق ارتقای قواعد حقوقی نظارتی بر طر‏ح‌‏ها نیز میسر است؛ می‏‌توان در میان انبوه قواعد حقوقی نظارت بر طرح‏‌های مذکور، آن نوع نظارتی را یافت که بیش از سایر اقسام، بر کارآمدی و کارایی طرح‌‏ها تاکید دارد. نظارت عملیاتی، نظارت بر کارآمدی و کارایی طرح‌‏های عمرانی است و در نظام حقوقی ایران، به موجب اصل 126 قانون اساسی، برعهدۀ رئیس جمهور است که ازطریق معاون خود، آن را اعمال می‌نماید. ازطرفی، در بسیاری از کشورها، مانند آمریکا، نظارت عملیاتی در صلاحیت دیوان محاسبات است که زیرنظر پارلمان است. با روش توصیفی‌‌تحلیلی و تحلیل اقتصادیِ حقوق، پرسش این است که آیا تغییر نهاد ناظر، از «سازمان برنامه و بودجه» به «دیوان محاسبات کشور» امکان‏‌پذیر است؟ اصل 55 قانون اساسی ایران، صرفاً نظارت سنتی را در صلاحیت دیوان محاسبات دانسته است و به نظر می‏‌رسد، باتوجه‌به قانون اساسی فعلی، امکان تغییرِ نهادِ صالح برای نظارت عملیاتی ممکن نیست.

efficiency and effectiveness of the government are integral components of good governance, and its realization in government investment in development projects also appears in legal rules, so it can be realized by improving the legal rules governing such projects. among the numerous legal rules of project controlling, it can be found the one that emphasizes the efficiency and effectiveness of the projects more than other types. operational supervision is controlling the efficiency and effectiveness of development projects, and in the iranian legal system, according to article 126 of the constitution, it is one of the responsibilities of the president who exercises it through his deputy. on the other hand, in many countries, such as the united states, operational supervision of the controlling pertains to the audit court, which in turn is overseen by parliament. the question is whether it is possible to change the controlling institution from &plan and budget organization& to the &supreme audit court&? article 55 of the iran constitution takes audit court only in charge of traditional controlling, so it seems that considering the current constitution, it is not possible to change the competent institution in charge of operational supervision.
