تحلیل کیفی چالش های فردی ماموران انتظامی در خصوص حقوق شهروندی متهمین بر مبنای نظریه زمینه‌ای(مورد مطالعه: پلیس های تخصصی فرماندهی انتظامی استان فارس)

هدف و زمینه: رعایت حقوق شهروندی متهمین یک الزام قانونی و عرفی است با این حال همواره در فرایند انجام وظایف و ماموریتهای محوله به پلیس، چالش ها و موانع مختلفی وجود دارد که در قالب های مختلف قابل دسته بندی است با توجه به اینکه یکی از شاخص ترین آنها «چالش های فردی» است. این پژوهش با هدف شناسایی چالش های فردی  و ارائه راهکارهای علمی و عملی به منظور رفع و یا کاهش این چالش ها به انجام رسیده است. روش: پژوهش حاضر از نظر هدف، کاربردی و ازنظر شیوه، کیفی است. تعداد 18 نفر از خبرگان انتظامی،کارشناسان و متصدیان اقدام انتظامی، مقامات قضایی و اساتید دانشگاهی‌در پژوهش مشارکت نمودند که با استفاده از روش نمونه‌گیری هدفمند و نظری انتخاب شدند. داده ها با استفاده از روش مصاحبه عمیق، جمع‌آوری و با روش نظریه زمینه ای و با توجه به مراحل سه‌گانه کدگذاری، با بهره گیری از نرم افزار مکس کیودی ای [1]تجزیه و تحلیل گردیدند.یافته ها: به‌طور کلی در فرایند تجزیه و تحلیل داده ها، تعداد 10 خرده مقوله خلق شد که از ترکیب این خرده مقوله‌ها، 3 مقوله اصلی شامل«عوامل روحی-روانی» ، « ناسازگاری متهمین » و « خصوصیات فردی-مهارتی مامورین» استخراج گردید و در نهایت مقولۀ هسته(کد گزینشی‌‌‌)این پژوهش چالش های فردی ماموران انتظامی  در خصوص حقوق شهروندی متهمین تعیین شدکه این مقوله کلیۀ مقوله‌های دیگر پژوهش را در بر می‌گیرد.نتیجه گیری: نتایج حاصله نشان داد که اهمیت رفع این چالش ها به حدی است که در صورت عدم مرتفع شدن آنها، مسلماً منجر به ایجاد جوبدبینی نسبت به پلیس، بروز مشکلات خدمتی و قضایی برای کارکنان، تضعیف و تضییع حقوق شهروندی متهمین خواهد شد.

qualitative analysis of the individual challenges of law enforcement officers regarding the citizenship rights of the accused based on contextual theory (case study: specialized police officers of fars province law enforcement command)

background and purpose: respecting the citizenship rights of the accused is a legal and customary requirement, however, there are always challenges and obstacles in the process of performing the duties and missions assigned to the police, which can be categorized in different formats, considering that one of the the most prominent of them is &individual challenges&. this research has been done with the aim of identifying individual challenges and providing scientific and practical solutions to solve or reduce these challenges.  method: the present research is applied in terms of purpose and qualitative in terms of method. a total of 18 police experts, law enforcement officers, judicial authorities, and university professors participated in the research and were selected using a theoretical and purposeful sampling method. the data were collected using the in-depth interview method and analyzed with the grounded theory method and according to the three stages of coding, using the max kyuda software.findings: in general, 10 sub-categories were created in the data analysis process, and from the combination of these sub-categories, 3 main categories were extracted, including &mental-psychological factors&, &incompatibility of the accused& and &individual-skill characteristics of the officers&. and finally, the core category (selective code) of this research was determined as the individual challenges of police officers regarding the citizenship rights of the accused, which includes all other categories of the research.conclusion: the results showed that the importance of solving these challenges is so great that if they are not solved, it will certainly lead to prejudice against the police, the occurrence of service and judicial problems for the employees, and the weakening and violation of the citizenship rights of the accused.
