چالش‌های قانونی- قضایی کارکنان پلیس در رعایت حقوق شهروندی متهمین

زمینه و هدف: اساساً رعایت نکردن حقوق شهروندی متهمین از سوی پلیس علاوه بر تبعات قانونی، آثار و عواقب اجتماعی در پی دارد که قانونگذار ضمانت اجراهای کیفری برای افرادی که این قوانین را رعایت نمی‌نمایند پیش‌بینی نموده، از اینرو در این پژوهش به موضوع فوق در پلیس های تخصصی فرماندهی انتظامی استان فارس پرداخته شده که هدف از آن شناسایی این چالش ها و ارائه راهکار به منظور رفع و یا کاهش این چالش ها می‌باشد. روش: پژوهش حاضر از نظر هدف، کاربردی و ازنظر شیوه، کیفی است. تعداد 18 نفر از خبرگان انتظامی،کارشناسان و عوامل انتظامی، مقامات قضایی و اساتید دانشگاهی‌ در پژوهش مشارکت نمودند که با استفاده از روش نمونه‌گیری هدفمند انتخاب شدند. داده ها با استفاده از روش مصاحبه عمیق، جمع‌آوری و با روش نظریه زمینه‌ای و با توجه به مراحل سه‌گانه کدگذاری،تجزیه و تحلیل گردیدند.یافته ها: به‌طور کلی در فرایند تجزیه و تحلیل داده ها، تعداد 13خرده مقوله خلق شد که از ترکیب این خرده مقوله‌ها،4 مقوله اصلی شامل چالش های ‌تقنینی-سازمانی‌‌‌‌‌‌‌، ‌‌‌‌‌‌لزوم اجرای دستورات قضایی بدون توجه به مقتضیات سازمان‌‌‌‌‌‌‌، ‌‌‌‌‌‌نادیده گرفتن وضعیت متهمین خاص‌‌‌‌‌‌‌ و ‌‌‌‌‌‌توقع بالا بدون پشتیبانی سازمان زندانها‌‌‌‌‌‌‌ استخراج و در نهایت مقولۀ هسته(کد گزینشی‌‌‌)این پژوهش چالش های قانونی- قضایی مرتبط با رعایت حقوق شهروندی متهمین تعیین شد.نتیجه گیری: نتایج حاصله نشان داد که اهمیت رفع این چالش ها به حدی است که در صورت عدم مرتفع شدن آنها، مسلماً منجر به ایجاد جوبدبینی نسبت به پلیس، بروز مشکلات خدمتی و قضایی برای کارکنان، تضعیف و تضییع حقوق شهروندی متهمین خواهد شد.

background and purpose: basically, non-observance of citizenship rights, the observance of the citizenship rights of the accused by the police, in addition to legal consequences, results in social consequences, which the legislator has foreseen to guarantee criminal executions for those who do not comply with these laws, therefore, in this research, the above topic has been discussed in the specialized police of fars police command, the purpose of which is to identify these challenges and provide solutions to solve or reduce these challenges.method: the present research is applied in terms of purpose and qualitative in terms of method. a total of 18 law enforcement experts, experts and law enforcement officers, judicial officials and university professors participated in the research and were selected using the purposeful sampling method. the data were collected using the in-depth interview method and were analyzed and analyzed with the grounded theory method and according to the three stages of coding.findings: in general, 13 sub-categories were created in the process of data analysis, and from the combination of these sub-categories, 4 main categories include legislative-organizational challenges, the need to implement judicial orders without regard to the requirements of the organization, ignoring the status of specific defendants. and the high expectation without the support of the prisons organization was extracted and finally the core category (selective code) of this research was determined legal-judicial challenges related to the observance of the citizenship rights of the accused.conclusion: the results showed that the importance of solving these challenges is so great that if they are not solved, it will certainly lead to prejudice against the police, the occurrence of service and judicial problems for the employees, and the weakening and violation of the citizenship rights of the accused.
