کدهای اخلاقی حاکمیت نسبت به مهاجران ورودی کار بر اساس اعلامیه جهانی حقوق بشر

در جهان امروز مهاجرت روندی رو به افزایش‌یافته و اشتغال یکی از مهم‌ترین انگیزه‌های مهاجرت است. حکومت‌ها در قبال مهاجران ورودی و خروجی، مسئولیت‌های اخلاقی خاصی دارند. این مقاله با روش توصیفی تحلیلی و از نوع کتابخانه‌ای به تبیین کدهای اخلاقی حاکمیت نسبت به مهاجران ورودی کار بر اساس اعلامیه جهانی حقوق بشر پرداخته است. اخلاق مهاجرت به طور عام و مسئولیت اخلاقی حاکمیت نسبت به مهاجران ورودی کار به طور خاص در پژوهش‌ها و مجامع بین‌الملل مغفول مانده است. در برخی امور زیرشاخه‌ای مهاجرت مانند گردشگری، نظام‌نامه‌های جهانی اخلاقی تدوین شده اما در مبحث مهم مهاجرت جز قوانینی حقوقی، توجه چندانی به مباحث اخلاقی نشده است. این مقاله با برشمردن مسئولیت‌های اخلاقی حاکمیت نسبت به مهاجران ورودی کار پنجره جدیدی به روی پژوهشگران و سیاستمداران باز می‌کند. مهاجرت حق هر انسانی است. در نگاه نخست، حق هر انسانی است که در هرجایی که علاقه دارد اقامت گزیند و شغل مناسب خود را انتخاب نماید و حکومت‌ها در نگاه نخست، نمی‌توانند و نباید مانع آنان شوند. حکومت‌ها از نظر اخلاقی نمی‌توانند نسبت به مهاجران کار بی‌تفاوت باشند. حاکمیت در قبال حقوق شهروندان و حقوق مهاجران، مسئولیت حقوقی دارد. حقوق شهروندان بر حاکمیت در اولویت است. چالش‌ها و آسیب‌های مهاجرت حکومت‌ها را وامی‌دارد به خاطر رعایت مصالح شهروندان از پذیرش بی‌رویه مهاجران جلوگیری کنند. لحاظ حقوق شهروندی، مسئولیت حاکمیت در قبال مهاجران را سلب نمی‌کند؛ بلکه حکومت‌ها با اولویت دادن به مصالح شهروندان خود باید در ادای حقوق مهاجران به ویژه مهاجران قانونی کار کوشا باشند.

Ethical codes of governance for incoming labor migrants based on the Universal Declaration of Human Rights

Daily migration is increasing and employment is one of the most important motivations for migration. Governments have special moral responsibilities to incoming and outgoing immigrants. This article uses a descriptiveanalytical and librarybased method to explain the ethical codes of governance towards incoming labor migrants based on the Universal Declaration of Human Rights. The ethics of immigration in general and the moral responsibility of the government towards incoming immigrants in particular have been neglected in research and in the international community. In some subbranches of immigration, universal moral codes have been developed But in the important issue of immigration, except for legal laws, little attention has been paid to ethical issues. This article opens a new window for researchers and politicians by listing the government’s moral responsibilities to incoming immigrants. Immigration is the right of every human being. At first glance, it is the right of every human being to live wherever he wants And choose the right job and governments, at first glance, can not and should not hinder them. Governments cannot be morally indifferent to labor migrants. The government has a legal responsibility for the rights of citizens and the rights of immigrants. Citizens’ rights take precedence over sovereignty. Migration Challenges force governments to prevent the uncontrolled admission of immigrants in the interests of citizens. Consideration of citizenship rights does not relieve the government of responsibility for immigrants; Rather, governments must work hard to ensure the rights of immigrants, especially legal immigrants, by prioritizing the interests of their citizens.
