مقایسه تطبیقی منع سوء استفاده از موقعیت مسلط در قانون رقابت ایران و کمیسیون اروپا: رویکردی انتقادی و پیشنهاد اصلاحی

جزء ط از ماده 45 قانون اجرای سیاست‌های کلی اصل 44 قانون اساسی به ممنوعیت سوءاستفاده از موقعیت مسلط اختصاص یافته است. مراجعه به تجارب تقنینی و رویه قضایی بین المللی و بررسی آراء شورای رقابت در رسیدگی به شکایات، ضرورت اصلاح موسع مقررات رقابتی جاری را نمایان میسازد. در این راستا بهتر است اختیارات متناسب در موضوع مجازات ناقضان مقررات (بویژه در خصوص سوء استفاده از موقعیت مسلط بازاری) به شورای رقابت اعطاء گردد. علاوه بر این در اصلاح قانون پیش‌بینی دیگر ابداعات حقوقی از جمله استثنائات یا معافیت ها، مرور زمان، تدابیر دستور موقت و برنامه تعهدات در جهت ایجاد بازدارندگی لازم و عملکرد موثر و مطلوب مرجع رقابتی غیر قابل انکار می‌باشد. اطلاعات این نوشتار با روش کتابخانه‌ای و مطالعه آراء حاصل شده و با بررسی و تحلیل آنها درصدد ارائه پیشنهادات نسبت به موارد مذکور می‌باشد.

A Comparative Comparison of the Prohibition of Abuse of Dominance in Iran’s Competition Law and the European Union Competition Law: A Critical Approach and Proposal for Correction

Part 8 of provision 45 of The Act on   Implementation of General Policies of article 44 of Iran’s Constitution is dedicated to prohibition of abuse of a dominant market position. Reviewing the legislative experience and international judiciary procedure as well as examining the Competition Council’s verdicts in dealing with complaints, highlights the need for extensive reform of current competition rules. In this regard, it is better to give appropriate powers to the Competition Council on the issue of punishing violators of regulations (especially regarding the abuse of the dominant market position). In addition, in amending the law, other legal innovations such as exceptions or exemptions, time lapse, measures of temporary order and schedule of obligations in order to create the necessary deterrence and effective and desirable performance of the competitive authority are undeniable.
