کرامت ذاتی حقوق کودک از نگاه حقوق ایران

مقاله حاضر، با هدف بررسی کرامت ذاتی کودک از نگاه حقوق ایران به روش توصیفی تحلیلی با استفاده از منابع کتابخانه ای انجام شد. نتایج نشان داد که، مبنای حقوق ایران؛ چهار اصل‌ و ارزش‌ اخلاقی‌ یعنی‌ کرامت‌ انسانی‌، آزادی، عدالت‌ و برابری است‌ و تلقی‌ اخلاقی‌ آن ها بر حقوق‌ کودک‌ بر اصول‌ مذکور استوار است‌. کرامت ذاتی حقوق‌ کودک‌ در ایران‌، بستگی‌ به‌ مبانی‌ انسان‌شناختی‌ و معرفت‌‌شناختی‌ و هم چنین‌ نحوه‌ نگرش‌ به‌ هستی‌‌شناسی‌ دارد. اصول‌ حقوق‌ کودک‌ در حقوق ایران بر اساس‌ مباحث‌ تعلیمی‌ و تربیتی‌ مبتنی‌ بر توجه‌ به‌ همه‌ ابعاد وجودی انسان‌ است‌. از نظر حقوق ایران؛ کودک‌ در فرایند تربیتی‌، نیازمند توجه‌ ویژه‌ ای است‌ و این‌ توجه‌ ویژه‌ منوط‌ به‌ اصل‌ کرامت‌ ذاتی‌ انسان‌ است‌ که‌ کودک‌ از آن‌ برخوردار است‌. از نظر حقوق ایران ، کودک‌ از آسیب پذیری بسیاری برخوردار است‌ و اگر در فرایند تربیت‌، حق‌ کرامت‌ ذاتی‌ رعایت‌ نگردد امکان‌ منحرف‌ شدن‌ کودک‌ از مسیر صحیح‌ و آسیب‌ رسیدن‌ به‌ تربیت‌ او زیاد است‌. زیرا بر اساس‌ روایات‌ اسلامی‌، کودک‌ زمینه‌ مستعدی برای دریافتن‌ هرگونه‌ امور خوب‌ و بد را دارد. در حقوق ایران نیز توجه‌ به‌ حقوق‌ کودک‌ بر اساس‌ حقوق‌ طبیعی‌ است‌ که‌ انسان‌ از آن‌ برخوردار است‌. اسلام‌ حق‌ آزادی را برای انسان‌ حقی‌ مسلم‌ می داند اما برای هریک‌ از حقوق‌ انسان‌ چارچوبی‌ قرار می دهد تا از حدود خود تجاوز نکرده‌ و باعث‌ تضییع‌ حقوق‌ دیگران‌ نگردد.

the present article was conducted with the aim of investigating the inherent dignity of the child from the perspective of iranian law, using a descriptive and analytical method using library sources. the results showed that the basis of iran's rights; the four moral principles and values are human dignity, freedom, justice, and equality, and their moral view on children's rights is based on these principles. the inherent dignity of children's rights in iran depends on the anthropological and epistemological foundations, as well as the way of looking at ontology. the principles of children's rights in iranian law are based on educational and educational discussions based on paying attention to all dimensions of human existence. in terms of iranian law; in the educational process, the child needs special attention, and this special attention depends on the principle of inherent human dignity that the child enjoys. according to iranian law, the child has a lot of vulnerability and if the right to inherent dignity is not respected in the education process, there is a high possibility of the child deviating from the right path and harming his education. because according to islamic traditions, a child has the ability to understand any good or bad things. in iranian law, attention to children's rights is based on the natural rights that humans have. islam considers the right to freedom as an absolute right for man, but it sets a framework for each of the human rights so that it does not exceed its limits and does not cause damage to the rights of others.
