تروریسم پدیده‌ای است که جهان معاصر ما به شکل پیچیده‌ای گرفتار آن شده و علیرغم تلاش گسترده برای مبارزه با این پدیده، امکان حذف یا کنترل جدی آن در آینده نزدیک نمی‌رود. بعد از حادثه 11 سپتامبر، تیم بوش پسر و نومحافطه‌کاران حاکم بر کاخ سفید به طراحی استراتژی مبتنی بر «جنگ پیشگیرانه» علیه تروریسم پرداختند و این سیاست در طول دو دهه آغازین قرن جدید در کاخ سفید استمرار داشته است. در این نوشتار ما با استفاده از روش توصیفی-تحلیلی و مطالعه کتب، اسناد و اخبار مربوطه، این راهبرد مبارزه با تروریسم را مورد بررسی قرار داده‌ایم و به این نتیجه رسیده‌ایم که این استراتژی باتوجه به مختصات جنگ پیشگیرانه (نیاز به دشمن سازی، دیدگاه خاص غرب به اسلام، یکجانبه گرایی، استاندارد دوگانه و تلاش برای توسعه هژمونی آمریکایی) و آثار و نتایج آن (عدم توجه به ریشه تروریسم، رد مسئولیت کیفری اتباع آمریکایی، رخداد فجایع و مسئولیت جمعی، افزایش محدودیت‌های سیاسی و اجتماعی و خشونت‌های حکومتی) در صورتی که با سیاستهای یکجانبه‌گرایانه آمریکا استمرار پیدا کند، منجر به افزایش شکاف با دستاوردهای جدید حقوق بین‌الملل در عرصه جزایی شده و در این صورت محکوم به شکست خواهد بود.
