بررسی تکامل حقوق بین ‌الملل منابع آبی؛ تحلیلی بر مقررات کنفرانس هلسینکی و تاثیر آن بر مدیریت آبراهه‌های بین‌المللی

زمینه و هدف: این مقاله به بررسی مقررات مربوط به منابع آبی و کشتیرانی در آبراهه‌های بین‌المللی می‌پردازد و تاثیر آن بر مدیریت پایدار منابع آبی را تحلیل می‌کند. همچنین به بررسی مذاکرات کمیته منابع آبی و تکامل حقوق بین‌الملل در این زمینه خواهد پرداخت. مواد و روش‌ها: روش مطالعه و گردآوری اطلاعات و یافته‌های پژوهش اصلی، تحلیلی توصیفی بوده است. ملاحظات اخلاقی: کلیه اصول اخلاقی حاکم در پژوهش، در ترجمه این مقاله رعایت شده است. یافته‌ها: گزارش نهایی کمیته منابع آبی در آوریل 2004 ارائه و در آگوست همان سال توسط انجمن حقوق بین‌الملل (ila) تصویب شد. این گزارش تاکید بر مشارکت ذی‌نفعان، پیشرفت‌های زیست‌ محیطی و الزامات قانونی برای مدیریت پایدار آب‌های بین‌المللی دارد. نتیجه‌گیری: تکامل حقوق حاکم بر منابع آبی بین‌المللی و نقش مهم توصیه‌های ila در شکل‌گیری نهادهای بین‌المللی مورد بررسی قرار گرفت. این توصیه‌ها می‌توانند به بهبود قوانین جهانی و ایجاد موسسه‌های مشخص در حوزه مدیریت منابع آبی منجر شوند.

background and aim: the article examines the regulations governing water resources and navigation in international waterways and their impact on sustainable water resource management. it also analyzes the deliberations of the water resources committee and the evolution of international water law in this domain.materials and methods: materials and methods: this is a descriptive study.ethical considerations: all ethical principles governing research have been observed in the presentation of this translation.findings: the final report of the water resources committee was presented in april 2004 and approved by the international law association (ila) in august the same year. this report emphasized stakeholder participation, advancements in environmental considerations, and legal requirements for sustainable management of international water resources.conclusion: the study highlights the evolution of legal frameworks for international water resources and the significant role of ila recommendations in shaping international institutions. these recommendations could contribute to the development of global regulations and the establishment of specific institutions for managing shared water resources.
