آینده‌ پژوهی در حقوق کیفری در پرتو خوانش‌ های فقهی

زمینه و هدف: آینده‌ پژوهی به‌ عنوان یک حوزه مطالعاتی نوین و میان‌رشته‌ای، با هدف بررسی روندهای احتمالی آینده و ارائه چشم‌اندازهای ممکن، به سرعت در حال توسعه است. این رشته با بهره‌گیری از روش‌های علمی و تحلیلی گوناگون، تلاش می‌کند تا تصویری روشن از آینده در حوزه‌های مختلف ارائه دهد. در این میان، با وجود تاکیدات فراوان دین مبین اسلام بر اهمیت آینده‌اندیشی و برنامه‌ریزی برای آن، حوزه آینده‌ پژوهی اسلامی آن‌گونه که شایسته است، مورد توجه و توسعه قرار نگرفته است. مواد و روش‌ها: پژوهش حاضر با استفاده از روش توصیفی-تحلیلی، ضمن بررسی و تحلیل خوانش‌های مختلف فقهی از منابع معتبر اسلامی، به‌دنبال شناسایی کارآمدترین خوانش فقهی از دین اسلام جهت شکل‌دهی به یک چارچوب منسجم برای آینده‌پژوهی در حقوق کیفری مبتنی بر موازین اسلامی است. ملاحظات اخلاقی: کلیه اصول اخلاقی حاکم در پژوهش، در نگارش این مقاله رعایت شده است. یافته‌ها و نتیجه‌گیری: اگرچه آموزه‌های غنی اسلامی، به‌ویژه قرآن کریم و سنت پیامبر اکرم (ص) و ائمه اطهار (ع)، سرشار از اشاراتی به آینده، سرنوشت جوامع، و لزوم آمادگی برای آن است، خلا یک چارچوب نظری منسجم در این زمینه احساس می‌شود. آینده‌پژوهی حقوق کیفری اسلامی، بر اساس خوانش‌های مختلف از متون دینی و منابع فقهی، ابعاد گوناگونی به خود می‌گیرد که بر کارآمدی و یا عدم کارآمدی آموزه‌های دین در باب مطالعه آینده اثر گذار است. این تنوع در نگرش‌ها و برداشت‌ها، ضرورت بررسی و تحلیل دقیق ظرفیت‌های هر یک از این خوانش‌ها را در توسعه آینده‌پژوهی حقوق کیفری اسلامی آشکار می‌سازد.

background and aim: futures studies, as a novel and interdisciplinary field of study, is rapidly developing with the aim of examining potential future trends and providing possible perspectives. by utilizing various scientific and analytical methods, this field strives to provide a clear picture of the future in different domains. meanwhile, despite the abundant emphasis of the islamic religion on the importance of foresight and planning for the future, the field of islamic futures studies has not received the attention and development it deserves.materials and methods: the present research, using a descriptive-analytical method, seeks to identify the most efficient jurisprudential interpretation of the islamic religion for shaping a coherent framework for futures studies in criminal law based on islamic principles, while examining and analyzing various jurisprudential readings of credible islamic sources.ethical considerations: all ethical principles were adhered to during the writing process of this research.findings and conclusion: although the rich islamic teachings, especially the holy quran and the tradition of the prophet muhammad (pbuh) and the imams (as), are full of references to the future, the fate of societies, and the necessity of preparing for it, the absence of a coherent theoretical framework is felt in this regard. futures studies of islamic criminal law, based on different readings of religious texts and jurisprudential sources, takes on various dimensions that affect the efficiency or inefficiency of religious teachings in the study of the future. this diversity in attitudes and perceptions reveals the necessity of carefully examining and analyzing the capacities of each of these readings in the development of futures studies of islamic criminal law.
