نسبیت ‌گرایی حقوق بشر در عمل، مطلق ‌گرایی حقوق بشر در سخن

زمینه و هدف: یکی از مسائل عمده حقوق بشری امروزه، دوگانگی حقوق بشر جهان‌شمولی و نسبی‌گرایی می‌باشد. هر دو رویکرد موافقان و مخالفانی داشته و هریک نیز به‌دنبال تبیین دیدگاه خود هستند و هر دولتی تحت تاثیر مبانی فلسفی و ارزش‌های فرهنگی و دینی خویش رویه متفاوتی را نسبت به این مساله در پیش گرفته است. مواد و روش‌ها: روش تحقیق در این پژوهش توصیفی تحلیلی و کتابخانه‌ای است. ملاحظات اخلاقی: کلیه اصول اخلاقی حاکم در پژوهش، در نگارش این مقاله رعایت شده است. یافته‌ها و نتیجه‌گیری: مقاله حاضر در مقام تبیین این مساله است که برای شناخت حقوق بشر، نخست باید نسبی‌گرایی را شناخت. سوالی که این نوشته درصدد پاسخ بر آن می‌باشد، آن است که آیا حقوق بشر به‌واقع، مطلق هستند؟ فرضیه‌ای که در پاسخ به سوال یادشده مطرح و درصد تبیین آن می‌باشد، این است که حتی آنانی که اعتقاد به مطلق‌گرایی در حقوق بشر دارند و در حوزه نظری به مطلق‌بودن حقوق بشر باور دارند، هنگامی وارد حوزه عمل می‌شوند، کردار و عملشان بیانگر نسبی‌بودن حقوق بشر می‌باشد. این مقاله درصدد رسیدن به این نتیجه بودیم که حتی مطلق‌گراها در کردارشان با مشی نسبی‌گرایانه به‌دنبال محقق‌شدن حقوق بشر هستند.

background and aim: one of the major issues of human rights today is the duality of universal human rights and relativism. both approaches have supporters and opponents and each of them seeks to explain their point of view and each government, under the influence of its philosophical foundations and cultural and religious values, has taken a different approach to this issue.materials and methods: the research method in this research is descriptive-analytical.ethical considerations: all ethical principles have been observed in the writing stages of this research.findings and conclusion: the present article explains that in order to understand human rights, one must first understand relativism. the question that this article tries to answer is, are human rights really absolute? the hypothesis that is raised in response to the mentioned question and the percentage of its explanation is that even those who believe in absolutism in human rights and believe in the absoluteness of human rights in the theoretical field, when they enter the field of action they express the relativity of human rights. it concludes that even the absolutists in their actions with a relativistic approach are looking for the non-realization of human rights. the findings of this article indicate that by stating what things in the supply of action can one believe in relativism.
