امکان ‌سنجی تحقق دولت - ملت مدرن در ایران از منظر فلسفه دولت و حقوق عمومی

زمینه و هدف: زایش دولت- ملت مدرن، محصول پیوند تاریخی و سیاسی- اجتماعی دولت و ساختارهای اجتماعی در اروپای غربی است. در ایران هم شکل اصطلاحاً مدرن این دولت در زمان رضا پهلوی ایجاد شد که چالش‌های بسیاری را در مناسبات قدرت میان دولت و جامعه با خود به همراه آورد. این نوشتار می‌کوشد تا با نظری بر ویژگی‌های استاندارد دولت مدرن در غرب، بافت قدرت سیاسی و دولت را در جمهوری اسلامی ایران مورد نقد و بررسی قرار دهد و به امکان‌سنجی و آسیب‌شناسی دولت مدرن در ایران بپردازد. مواد و روش‌ها: روش مطالعه و گردآوری اطلاعات و یافته‌های پژوهش، توصیفی-تحلیلی می‌باشد. ملاحظات اخلاقی: کلیه اصول اخلاقی حاکم در پژوهش، در تقریر این مقاله رعایت شده است. یافته‌ها و نتیجه‌گیری: یافته‌های این مقاله نشان می‌دهد هرچند در برهه‌ای از تاریخ ایران رگه‌هایی از مدرنیزاسیون مشاهده شده اما با اندکی تامل در ساختار قوانین و مقررات و تعمق در رویه‌های حاکم، می‌توان دریافت که در بافت حکمرانی جامعه ایرانی ابهامات و عدول‌های فراوانی از معیارهای ناب دولت- ملت مدرن رخ داده است که به خلق دولت مدرن از درون این ساختار باید با دیده تردید نگریست. 

feasibility of realizing the modern nation-state in iran in perspective of state philosophy and public law

background and purpose: the birth of the modern nation-state is the product of the historical and political-social connection of the state and social structures in western europe. in iran, the so-called modern form of this government was created during the time of reza pahlavi, which brought with it many challenges in the power relations between the government and the society. this article tries to criticize the structure of political power and the government in the islamic republic of iran by commenting on the standard characteristics of the modern state in the west and to examine the feasibility and pathology of the modern state in iran.materials and methods: the method of studying and gathering information and research findings is descriptive-analytical.ethical considerations: all ethical principles governing research have been observed in the presentation of this article.findings and conclusions: the findings of this article using the library method show that although traces of modernization have been observed at some point in iran’s history, but with a little reflection on the structure of laws and regulations and meditation on the ruling procedures, it can be seen that in the context of governance of iranian society, there are many ambiguities and deviations from the standards. the emergence of the modern nation-state has occurred, and the creation of a modern state from within this structure should be viewed with skepticism.
