بررسی حقوقی نقش بلاکچین در قراردادهای هوشمند حوزه مالکیت فکری

زمینه و هدف: توسعه تکنولوژی و فناوری بلاکچین در سال‌های اخیر تاثیر به‌سزایی در زندگی انسان ایفا کرده است و حتی عده‌‌ای بر این باورند که انقلاب صنعتی چهارم آغاز شده است. قراردادهای هوشمند تحت نظارت هوش مصنوعی در بستر بلاکچین منعقد‌ می‌شوند‌، عوض قراردادی که در آنها دارایی‌های مجازی یا ارزهای رمزنگاری شده دیجیتال‌ می‌باشد. این قراردادها با بهره‌گیری از ویژگی‌های منحصر به فرد خود هم چون امنیت‌، ثبات و خود اجرایی ظرفیت‌های جدیدی را در حوزه معاملاتی برای انسان به‌وجود آورده است.مواد و روش‌ها: روش تحقیق در این مقاله به‌صورت توصیفی بوده است.ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است.یافته‌ها: پیشرفت فن‌آوری دوره گذار از مفاهیم سنتی و ورود مفاهیم مدرن و جدید را در ساحت حقوق پدید آورده‌ است این در حالی است که سرعت و پیچیدگی فناوری، چالش‌هایی را در نظام حقوق قراردادها به همراه داشته است، از جمله این چالش‌ها پاسخگویی و انطباق مبانی موجود با مفاهیم جدید در عرصه حقوق قراردادها است. این پژوهش به بررسی حقوقی نقش بلاکچین در قراردادهای هوشمند حوزه مالکیت فکری می­پردازد و با تدقیق در خصیصه‌های این قرارداد امکان بهره‌گیری از آنها را در حوزه قراردادی و در جهت حمایت و حفاظت حداکثری از مالکیت‌های فکری مشخص می­کند. نتیجه‌گیری: از جمله تاثیرات سودمند این فناوری بر مالکیت‌های فکری افزایش سرعت، کاهش هزینه‌های ثبت، حفظ سوابق حقوق فکری، رهگیری و مدیریت مالکیت‌های فکری‌ می‌باشد. اما این فناوری نیز همانند هر فناوری نوظهور دیگر جهت پیاده‌سازی در نظام حقوقی در ابتدا نیازمند تغییر در زیرساخت‌ها و تدوین قوانین و مقررات لازم است.
