گستره‌ی ولایت در فقه و حقوق با تاکید بر کلام شیخ طوسی

زمینه و هدف: ولایت فقیه پیشینه ای طولانی در متون فقهی و کلامی و عقیدتی تشیع دارد. تحلیل این جایگاه و اختیارات آن در کلام شیخ طوسی و قانون اساسی جمهوری اسلامی ایران از اهداف این تحقیق است.مواد و روش ها: روش تحقیق در این پژوهش به صورت توصیفی تحلیلی است.ملاحظات اخلاقی: در این تحقیق، اصالت متون، صداقت و امانت داری رعایت شده است.یافته ها: عقیده شیخ طوسی قضاوت از جمله مناصب امام معصوم و همچنین فقهایی که از طرف معصوم برگزیده شده اند است. فقیه در غیاب معصوم می تواند، خمس و زکات و زکات فطره را دریافت کند، همچنین می تواند، امامت جماعت نماز عیدین و جمعه را برعهده داشته باشد و البته با توجه به شرایط اجتماعی و سیاسی زمان شیخ طوسی بسیاری از اختیارات فقیه به صورت تقیه محدود شده است. در قانون اساسی اصل هایی به اختیارات ولایت فقیه اشاره دارد که با توجه به دیدگاه امام خمینی (ره) تنظیم شده و در بازنگری هایی که در آن به وجود آمد، بر اختیارات رهبری افزوده شده است.نتیجه گیری: ولایت فقیه در اندیشه فقهای طراز اول تشیع از جمله شیخ طوسی و نیز اصول قانون اساسی جمهوری اسلامی ایران که براساس متون و فقه اسلامی نگارش یافته است دارای اختیارات گسترده ای می باشد.

VelayeteFaqih in Jurisprudence and Law with Emphasis on the Words of Sheikh Tusi

Background and Aim: VelayateFaqih has a long history in Shiite jurisprudential, theological and ideological texts. The purpose of this research is to analyze this position and its powers in the words of Sheikh Tusi and the Constitution of the Islamic Republic of Iran.Materials and Methods: This syudy id of descriptive analytical one.Ethical Considerations: Authenticity of the texts, honesty has been observed in this study.Findings: According to Sheikh Tusi, judging is one of the positions of the Infallible Imam as well as the jurists chosen by him. In the absence of the Imam, the jurists can receive khums, zakat, and zakat alfitr. He can also lead the congregation of Eid prayers and Friday prayers. And of course, according to the social and political conditions of the time of Sheikh Tusi, many of the powers of the jurist had limited by Taqiyya. In the constitution, there are some principles referring to the powers of VelayateFaqih, which have been regulated according to Imam Khomeini’s views, and in the revisions that took place in it, the powers of the leadership have been added.Conclusion: VelayateFaqih has wide authority in the opinion of firstrange Shiite jurists, including Sheikh Tusi, as well as the principles of the Constitution of the Islamic Republic of Iran, which is based on Islamic texts and jurisprudence.Please Cite This Article As: Davar Panah, SM; Razmi, SM & Rajaeipour, M (2021). “VelayeteFaqih in Jurisprudence and Law with Emphasis on the Words of Sheikh Tusi”.
