بررسی جایگاه فقهی و حقوقی مجازات تشهیر در ایجاد امنیت عمومی و ارتقاء حقوق شهروندی

زمینه و هدف: پژوهش حاضر جایگاه مجازات تشهیر در ایجاد امنیت عمومی و حقوق شهروندی را بررسی نموده است.روش پژوهش: روش مورد استفاده در این پژوهش، توصیفی-تحلیلی بوده که با بهره گیری از متون فقهی، منابع اسنادی و کتابخانه ای و به شیوه استدلالی به بحث حاضر پرداخته است.یافته ها: یافته های پژوهش حاضر نشان داده که مجازات تشهیر به دلیل انتشار اسامی مختلفان و مفسدان، ایجاد شفافیت در جامعه، توجه به جنبه‌های بازدارنده، نفی و جلوگیری از ضرر رساندن به شهروندان و توجه به اصول کرامت و عدالت دارای آثار مهمی بر حقوق شهروندی و ارتقای امنیت عمومی است.نتیجه‌گیری: تسری بخشیدن مجازات تشهیر به مسائلی مانند فسادهای اقتصادی و اجتماعی، شفافیت را به عنوان شاکله حقوق شهروندی مطرح ساخته و در قانون مجازات اسلامی نیز مورد تایید قرار گرفته است. علاوه بر شناسایی و رسوا ساختن مجرمان، مجازات تشهیر حتی می تواند درباره انتشار نام قضات و مراجع ناقض حقوق شهروندان اِعمال شده و این امر بر عهده دستگاه قضایی است که زمینه های لازم را برای آزادی رسانه ها و اصل تشهیر رسانه ای فراهم آورد.

Investigating the place of extortion in creating security and social deviations and its impact on citizenship rights

Background and objective: The present study investigated the place of the punishment of defamation in creating public security and civil rights.Method: The method used in this research is descriptiveanalytical, which has discussed the present discussion using jurisprudential texts, documentary sources and libraries in an argumentative manner.Findings: The findings of the present study showed that due to the publication of violators and corrupters, creating transparency in society, paying attention to deterrent aspects, prevention of harm to citizens, and paying attention to the principles of dignity and justice the punishment of defamation has important effects on the citizenship rights and the promotion of public security.Results: Extending the punishment of defamation to issues such as economic and social corruption has introduced transparency as a form of citizenship rights and has been endorsed in the Islamic Penal Code. In addition to identifying and exposing the perpetrators, the punishment of defamation can even be applied to the publication of the names of judges and authorities that violate the rights of citizens, and this is the responsibility of the judiciary, which provides the necessary grounds for media freedom and the principle of media defamation.
