عدالت‌ترمیمیِ فناورانه با تاکید بر نقش پلیس

زمینه و هدف: در کشورهای دارای قوانین مدون، عدالت کیفری در حال تجربه تحول از حوزه عدالت ارعابی به عدالت‌ترمیمی است. عدالت‌ترمیمی برخلاف عدالت کیفری سنتی، در اجرای عدالت، نقش محوری به بزه دیده اعطا می‌کند. این نقش در بسیاری از فرایندهای دادرسی کیفری موثر بوده است که به‌طور مشخص، میانجی‌گری بزه دیده بزه‌کار یکی از فرایندهای ثابت ‌شده است. هدف از این پژوهش، تبیین عدالت‌ترمیمی پیشگیرانه پلیس با استفاده از ظرفیت‌های موجود در فناوری اطلاعات و ارتباطات است.روش: پژوهش پیشرو یک تلاش توصیفی تحلیلی با رویکرد کاربردی است. در این پژوهش از ابزار فیش‌برداری برای جمع‌آوری اطلاعات مستخرج از اسناد کتابخانه‌ای و الکترونیکی استفاده شده است.یافته‌ها: یافته‌های این پژوهش نشان داد، فضای سایبری به جهت تسهیل ارتباط بین اصحاب دعوا و نیز دارا بودن ویژگی‌هایی از قبیل در دسترس بودن، سرعت، دقت، عدم مواجهه حضوری و ... می‌تواند بستر مناسبی برای اجرای عدالت‌ترمیمی باشد.نتایج: به‌موجب نتایج حاصل از این پژوهش، اگرچه مدل آنلاین (برخط) میانجی‌گری بزه دیده بزه‌کار تاکنون اجرا نشده است، امّا این دیدگاه می‌تواند در شرایط خاص جایگزین مناسبی برای حالت حضوری باشد. باوجوداین، روشن است که برای درک کامل ساختار و پیامدهای یک سامانه برخط برای حل‌وفصل اختلافات جنایی، به پژوهش‌های بیش‌تری نیاز است.

Technological Restorative Justice with Emphasis on the Role of the Police

Background and objectives: In countries with codified laws, criminal justice is experiencing a shift from intimidating justice to restorative justice. Restorative justice, unlike traditional criminal justice, gives the victim a pivotal role in the administration of justice. This role has been effective in many criminal proceedings, and specifically, victimoffender mediation is one of the proven processes. The purpose of this study is to explain the preventive restorative justice of the police using the existing capacities in information and communication technology. Methodology: The present research is a descriptiveanalytical effort with an applied approach. In this research, notetaking tools have been used to collect the data extracted from library and electronic documents. Findings: The findings of this study showed that cyberspace can be a good platform for restorative justice to facilitate communication between litigants and also has features such as availability, speed, accuracy, no facetoface confrontation, etc. Results: According to the results of this study, although the online model of victimoffender mediation has not been implemented so far, but this view can be a good alternative to the facetoface situation in certain circumstances. However, it is clear that more research is needed to fully understand the structure and implications of an online system for resolving criminal disputes.
