خودانضباطی و خودتنظیمی، راهکار جرم زدایی از جرایم سازمان‌های دولتی( مورد پژوهی: طرح آزادسازی سواحل خزر)

سازمان های دولتی در توسعه و پیشرفت جوامع نقش حیاتی دارند. با این وجود، ارتکاب هر گونه جرم و تخلف از سوی این سازمان ها می تواند پیآمدهای جدی برای جامعه داشته باشد. از این رو، در پیش گرفتن تدبیرهایی برای افزایش خودانضباطی و خودتنظیمی در سازمان های دولتی به بهبود قابل توجهی در عملکرد سازمان های دولتی و پیشگیری از جرایم ارتکابی از سوی آنان خواهد انجامید. نتایج این پژوهش نشان که با روش تحقیق مطالعه موردی انجام پذیرفته است، نشان می دهد، دولت با معرفی طرح آزادسازی حریم سواحل دریا، ارتکاب جرایم مرت بط با رعایت نشدن حریم قانونی سواحل دریا به دست نهادهای حاکمیتی را پذیرفته است. با این وجود، مجازات را پاسخی مناسب برای مقابلهبا رفتارهای مجرمانه صورت گرفته ندانسته است، بلکه سیاست های خودانضباطی را به عنوان یکی از اشکال جرم زدایی از جرایم ارتکابی در دستور کار خود قرار داده است تا از رهگذر بهبود عملکرد سازمان های دولتی برای رعایت حریم ساحل، ضمن الگوسازی برای رعایت قانون از سوی نهادهای حا کمیتی و پیشگیری از جرم در راستای تحقق عدالت اجتماعی گام بردارد.

self-discipline and self-regulation, the solution of decriminalization of crimes of government organizationscase study: caspian coast liberation plan

government organizations play a vital role in the development and progress of societies. nevertheless, the commission of any crime and violation by these organizations can have seriousconsequences for the society. therefore, taking measures to increase self-discipline and self-regulation in government organizations will lead to a significant improvement in the performance ofgovernment organizations and prevention of crimes committed by them. the results of this research,which was conducted with the case study research method, show that the government hasaccepted the commission of crimes related to non-compliance with the legal protection of the seacoast by the government institutions by introducing the plan to liberate the sea coast. nevertheless,it has not considered punishment as a suitable response to deal with criminal behavior, but has putself-discipline policies as one of the forms of decriminalization of committed crimes in its agenda, in order to improve the performance of government organizations to respect the coast, while setting a pattern for law enforcement by governing institutions and crime prevention in order to achieve social justice.
