هم‌ سنجی صلاحیت و اداره شورای شهر با مجلس شورای اسلامی و معرفی الگوی شایسته

اصل هفتم قانون اساسی شوراهای محلی را در ردیف مجلس شورای اسلامی از ارکان تصمیم‌گیری و اداره امور کشور دانسته است. مشارکت در تصمیم‌گیری و اداره کشور مستلزم وجود اختیار و قدرت می‌باشد. از آن جایی که شوراهای محلی در واقع پارلمان محلی می‌باشند، آیا شوراهای محلی به مانند مجلس شورای اسلامی واجد اختیارات و قدرت کافی برای ایفای این نقش اساسی و بنیادین خود می‌باشد و چگونه می‌توان از مجلس شورای اسلامی الگوی مناسب برای حکمرانی بهتر شوراها به دست آورد. در جهت روشن‌تر شدن مطلب نگاهی گذرا به تشابهات و تفاوت‌های شورای‌های شهر و مجلس شورای اسلامی ضروری است. در قالب مقرراتی که هم اکنون لازم‌الاجرا می‌باشند، شوراهای محلی از لحاظ، مقید بودن کلیه مصوبات با موازین اسلام، انتخاب مستقیم توسط مردم، جنبه مشورتی، نظارتی و عضویت اقلیت‌های مذهبی همانند مجلس شورای اسلامی است. این در حالی است که با ملاحظه مقررات مربوط به شورای اسلامی در می‌یابیم که از جنبه حدود وضع مصوبات، صلاحیت، علنی‌ بودن، سلب عضویت و انحلال با مجلس شورای اسلامی قابل مقایسه نیستند. در نوشتار حاضر با استفاده از روش توصیفی- تحلیلی و شیوه کتابخانه ای به این نتیجه می‌رسیم که بهبود الگوی حاکم بر اداره شورای شهر از رهگذر الگوبرداری از مجلس شورای اسلامی و اِعمال برخی الگوهای نوین امکان پذیر می باشد.

in the 7th principle of the constitution, local councils are considered at the level of islamic consultative assembly as one of the main decision-making bodies of the country. participating in decision-making and running the country requires authority and power. since local councils are actually local parliaments, have the local councils like the parliament enough authority and power to fulfill this fundamental role and how to obtain a suitable model from the parliament for better governance of councils. in order to clarify the issue, it’s necessary to consider the similarities and differences of the local councils and islamic assembly. they are similar in terms of the legal regulations that are enforceable, the bounding of all approvals on the islamic laws, being directly selected by people, the consultative and supervisory aspect and the membership of minorities. however, the local councils differ in terms of the limits of legislation, competency, publicity, cancellation of membership and dissolution. therefore, the local councils are considered as the entity with just consultative and cooperative nature and without the least supervisory or decision making and governance power.
