امکان‌سنجی انتقال و فروش اراضی واگذار شده به دانشگاه‌ها

اموال در اختیار دانشگاه‌ها به دو گروه اموال اختصاصی دانشگاه‌ها و اموالی که صرفاً حق بهره‌برداری آن‌ها به دانشگاه‌ها واگذار شده، قابل تقسیم می باشند. مدیران برخی از دانشگاه‌ها با استناد به اینکه بر اساس قوانین و مقررات مربوطه دانشگاه‌ها از شمول مقررات مالی، اداری و استخدامی کشور مستثنی می‌باشند و صرفاً مصوبات هیات‌ امناها و آیین‌نامه مالی و معاملاتی دانشگاه نسبت به آن‌ها لازم‌الاجرا هستند، بر اساس مصوبات هیات‌ امنای دانشگاهها، اقدام به فروش و انتقال اراضی واگذار شده به دانشگاهها که جزء اموال قسم دوم می‌باشند به اعضای هیات علمی، کارکنان دانشگاه و افراد عادی نمودهاند، بر اساس ماده 69 قانون تنظیم بخشی از مقررات مالی دولت، رای وحدت دیوان عدالت اداری، رویه اداری و آراء قضایی، صرفاً حق بهره‌برداری این اراضی به دانشگاهها واگذار شده و مالکیت آن متعلق به دولت می‌باشد؛ بنابراین این اقدام مدیران دانشگاه‌ها فراتر از اختیارت آن‌ها و برخلاف قانون بوده و امکان انتقال و فروش این اراضی وجود ندارد.
