آسیب شناسی تقنینی فعالیت احزاب سیاسی با تاکید بر اصلاح ساختارهای اداری

امروز نقش احزاب در برگزاری یک انتخابات کارآمد و سالم انکارناپذیر است و تقریباَ در همه نظام‌های حقوقی و در هر انتخابات‌، احزاب سیاسی کم و بیش فعال هستند. مهمترین کاستی های تقنینی فعالیت احزاب سیاسی را باید در ساختار های اداری موجود در زمینه فعالیت احزاب سیاسی جست. این ساختار های اداری شامل وظایف و اختیارات وزیر کشور به عنوان یکی از مقامات اداری کشور و کمیسیون ماده 10 احزاب سیاسی به عنوان یکی از کمیسیون های اداری در ارتباط با احزاب سیاسی است. این تحقیق به روش توصیفی و تحلیلی انجام گرفته است. نتایج تحقیق نشان داد که نظام مجوزدهی کنونی در زمینه فعالیت احزاب سیاسی، ترکیب کاماً دولتی کمیسیون ماده 10 احزاب، ناممکن بودن شکایت از تصمیمات این کمیسیون در ردّ درخواست متقاضیان تاسیس حزب، شیوه تخصیص یارانه احزاب سیاسی و وضعیت حوزه بندی انتخابات مجلس شورای اسامی از مهم ترین کاستی های ساختار های اداری موجود در زمینه فعالیت احزاب سیاسی است.

legislation pathology of political party’s activity with emphasis on reforming administrative structures

today, the role of parties in holding an efficient and healthy election is undeniable, and political parties are more or less active in almost all legal systems and in all elections. the most important legal shortcomings of the activity of political parties should be sought in the existing administrative structures in the field of political parties. these administrative structures include the duties and powers of the minister of interior as one of the administrative authorities of the country, as well as the article 10 commission of political parties as one of the administrative commissions in relation to political parties. this research was done by descriptive and analytical method. the results of the research showed that the current licensing system in the field of political parties, the completely governmental composition of the article 10 party commission, the impossibility of complaining about the decisions of this commission in relation to the rejection of the applications of the applicants for the establishment of the party, the way of allocating subsidies to political parties, and the state of election constituencies. the islamic council is one of the most important shortcomings of the existing administrative structures in the field of political parties.
