طراحی الگوی مطلوبِ ابتکار تقنینی در حقوق قانون‌گذاری ایران

ابتکار تقنینی یا ابتکار قانون، به عنوان ابزاری تقنینی در بطن و در بدو فرآیند جامع‌تر و کلی‌ترِ قانون‌گذاریْ، از حائز اهمیت‌ترین موضوعاتِ مطروحه در حوزۀ مطالعاتی حقوقِ قانون‌گذاری و تقنین است که متاسفانه نظام حقوقی کشور بر خلافِ محصول نهایی آن یعنی قانون، بطور متمرکز، مستمر و پویا بدان توجه خاصی مبذول نداشته ‌است. از این رو برای تبیین اهمیت موضوع مذکور و ضرورت توجه بیشتر به آن و بر اساس شرایط موجود، پژوهش حاضر درصدد است تا با شناسایی مبانی و مولفه‌های موثر، به طراحی الگوی مطلوب ابتکار تقنینی در حقوقِ قانون‌گذاری ایران بپردازد. در این مسیر به منظور پردازش مسئله، از راهبرد پژوهش کیفی و از نوع تحلیل مضمون بهره‌گرفته و از مصاحبه نیمه استاندارد با خبرگان حوزه قانون‌گذاری که با استفاده از روش نمونه-گیریِ نظری انتخاب شده ‌بودند در گردآوری داده‌های پژوهش استفاده گردید. با کاربست روش تحلیل مضمون از نوع شبکۀ مضامین، داده‌ها مورد تحلیل قرار گرفته و در نهایت مدل مفهومی اندازه‌گیری شبکه‌ای برساخته شد. یافته‌های پژوهش کیفی نشان داد که طراحی الگوی مطلوبِ ابتکار تقنینی شامل چهار مضمون فراگیر؛ «آشنایی با مفاهیم، مبانی، اصول و قواعد ابتکار تقنینی»؛ «دانش، تخصص و استانداردهای علمی در ابتکار تقنینی»؛ «جلب مشارکت و بهره‌مندی از مکانیزم-های سازندۀ جامعۀ مدنی»؛ و «راهبرد تقنینی مشخص» می‌باشد. علاوه بر آن، جهت «اعتبارسنجیِ» مضامین و مدل برساخته ‌شده، از دو روش ارزیابی اعتبار به شیوۀ ارتباطی و نیز روش ممیزی و به منظور «پایایی‌سنجی» از دو روش قابلیت تکرارپذیری و نیز قابلیت انتقال یا تعمیم‌پذیری استفاده شده ‌است.

designing a desirable model of legislative initiative in iranian legislative studies law

the legislative initiative, as a legislative tool at the beginning and inside of the more comprehensive legislative process, is one of the essential issues in the legislative studies law and legislation. unfortunately, unlike its final product, the law, iran’s legal system has not focused, consistent, and dynamic attention. therefore, to clarify the importance of this issue and the need to pay more attention to it, based on the existing circumstances, the present study aims to design a desirable model of legislative initiative in iran legislative studies law by identifying the principles and effective components.the qualitative research method and thematic analysis had used. the research’s data were collected using semi-standard interviews with experts in the field of legislation, elected using the theoretical sampling method. data were analyzed using the thematic analysis method in the thematic network. finally, a conceptual model of network measurement had constructed. the qualitative research findings show that the design of the desired model of the legislative initiative includes four comprehensive themes: comprehension of the concepts, fundamentals, rules, and principles of the legislative initiative knowledge, expertise and scientific standards in the legislative initiative participation of citizens and utilizing from the mechanisms of civil society and is a specific legislative policy”. in addition, to validate the themes and the constructed model, two methods of evaluating the validity of the communicative method and the audit method have been used. to reliability, two ways of reproducibility and transferability or generalizability have been used.
