مفهوم و مصادیق موسسه عمومی غیردولتی در نظام حقوقی ایران

عدم تمرکز از اساسی‌ترین مفاهیم حقوق اداری و یکی از بسترهای مهم برای مشارکت بخش غیردولتی در امور بوده که عبارت است از اعطای شخصیت حقوقی به واحدهای مستقل غیردولتی و شناسایی صلاحیت عام اجرایی و تصمیم گیری در امور عمومی توسط موسسات غیردولتی. موسسات غیردولتی گونه جدیدتر موسسات عمومی هستند که مفهوم و ویژگی‌های تبیین ‌شده توسط قانون‌گذار در ایران برای آن‌ها، کاملا واضح نیست که همین امر موجب حدوث اختلاف در مصادیق آن‌ها شده است با توجه به اهمیت این موضوع در تعیین قلمرو مقررات معمومی کشور، نظارت قضایی و سازمانی و نیز تشخیص مراجع صالح حین دادرسی انجام پژوهشی جامع در این خصوص راهگشا می‌باش. این نوشتار در پی پاسخ به پرسش از چیستی مفهوم موسسه عمومی غیردولتی در قوانین موضوعه ایران و تعیین سنجه‌ای تشخیص آن است. در این پژوهش با روش توصیفی تحلیلی کوشش شده به این پرسش پاسخ داده شود و به صورت خاص دو مورد سخت و چالشی از مصادیق احتمالی آن یعنی شورای شهر و فدراسیون فوتبال مورد بررسی قرار گیرد.

decentralization is one of the most basic concepts of administrative law and one of the important contexts for the participation of the non-governmental sector in affairs, which is the granting of legal personality to independent non-governmental units and recognition of general executive authority and decision-making in public affairs by non-governmental organizations. non-governmental organizations are a newer type of public institutions for which the concept and characteristics explained by the legislator in iran are not quite clear, which has led to differences in their examples. judicial and organizational, as well as the identification of competent authorities during the trial, conducting a comprehensive research in this regard is helpful. this article seeks to answer the question of what is the meaning of public non-governmental organization in the relevant laws of iran and determine the criteria for its recognition. in this research, an attempt has been made to answer this question with a descriptive-analytical method, and in particular, two difficult cases and challenges of its possible examples, namely the city council and the football federation, have been examined.
