آسیب شناسی ساختار و صلاحیت هیئت رسیدگی به امور مراکز فرهنگی؛ ارائه الگوی مطلوب دادرسی اداری

در نظام حقوقی ما، نهادهای متعددی مرجع سیاست گذاری در امور فرهنگی به شمار می‌روند. در این میان، وزارت فرهنگ و ارشاد اسلامی به عنوان متولی اصلی اداره امور فرهنگی نقش مهمی در صدور مجوز موسسات فرهنگی دارد. صدور مجوز موسسات فرهنگی بر اساس موازینی صورت می‌گیرد که توسط وزارتخانه مزبور تعیین می‌گردد اما پس از صدور مجوز موسسات فرهنگی، وزارت فرهنگ، نظارت پسینی خود را از طریق هیئت رسیدگی به امور مراکز فرهنگی اعمال می‌نماید. با بررسی سند موسس این مرجع یعنی «ضوابط و مقررات تاسیس مراکز، موسسات، کانون‌ها و انجمن‌های فرهنگی و نظارت بر فعالیت آنها» می‌توان ساختار و صلاحیت‌های مقرر برای هیئت مزبور را مورد شناسایی قرار داد و با یک تحلیل حقوقی انتقادات وارد بر آن را برشمرد. از جمله ایرادات ساختاری می‌توان به دولتی بودن تمام اعضای هیئت، قائم به شخص بودن تصمیمات صادره از هیئت و عدم استفاده از نهادهای مردمی در ترکیب هیئت اشاره کرد و در خصوص ایرادات صلاحیتی نیز می‌توان به ابهام در مورد صلاحیت‌ها و اختیار گسترده در اعمال تنبیهات انضباطی اشاره کرد. با توجه به اهمیت نهادهای فرهنگی و تاثیری که در حقوق فرهنگی دارند، عملکرد صحیح این نهادها در نهایت به ارتقای حقوق فرهنگی خواهد انجامید. در این مقاله، ما به دنبال ارائه الگویی جامع با تاکید بر معیارهای دادرسی عادلانه و نیز حکمرانی مطلوب هستیم. روش تحقیق در این پژوهش از نوع توصیفیتحلیلی است و در جمع‌‌آوری منابع از روش کتابخانه‌ای استفاده شده است.

in our legal system, several institutions are the policy reference in cultural affairs. meanwhile, the ministry of culture and islamic guidance, as the main trustee of the department of cultural affairs, has an important role in issuing licenses to cultural institutions. licensing of cultural institutions is based on criteria set by the ministry, but after the licensing of cultural institutions, the ministry of culture exercises its posterior supervision through the board of cultural centers. by examining the founding document of this authority, ie, &rules and regulations for the establishment of cultural centers, institutions, centers and associations and supervising their activities&, the structure and competencies prescribed for the said board can be identified and with a legal analysis enumerated the criticisms leveled at it. among the structural objections, we can mention the governmental nature of all the members of the board, the independence of the decisions issued by the board, and regarding the competence objections, we can mention the ambiguity about the competencies and the wide authority to apply disciplinary sanctions.given the importance of cultural institutions and the impact they have on cultural rights, the proper functioning of these institutions will ultimately lead to the promotion of cultural rights. in this article, we seek to provide a comprehensive model with an emphasis on fair trial standards as well as good governance. the research method in this research is descriptiveanalytical and library method has been used in collecting resources.
