برداشت بریتانیایی از تمرکززدایی

در دهه‌های اخیر بسیاری از دولتکشورها به دنبال طرح‌ریزی و یا اصلاح نظام واگذاری و تفویض اختیارات به واحدهای محلی خود بوده‌اند. با توجه به پیشینه دیرینه فرانسه در زمینه تمرکززدایی بسیاری از دولتکشورها از الگوی فرانسوی تمرکززدایی پیروی می‌کنند. با این وجود، در بریتانیا برداشتی متفاوت از تمرکززدایی سبب متمایز شدن ساختار حقوقیسیاسی این کشور از سایر کشورها شده است. در این پژوهش به مطالعه نظام تمرکززدایی در بریتانیا پرداخته‌ایم. با در نظر گرفتن ابعاد مختلف موضوع، می‌توان تمرکززدایی در بریتانیا را در واقع واگذاری اختیارات سیاسی و قانونگذاری یا به تعبیر دقیق‌تر «اختیار‌سپاری » در بسیاری از امور محلی به واحدهای تشکیل‌دهنده «پادشاهی متحد» دانست. این بدین معنا است که در بریتانیا نگرش متفاوت و خاصی از تمرکززدایی در قیاس با الگوی فرانسوی حاکم بوده و نظام عدم ‌تمرکز در این کشور از اعطای اختیار تصمیم‌گیری اداری و اجرایی صِرف به واحدهای محلی فراتر رفته و به واگذاری صلاحیت قانونگذاری در امور محلی به واحدهای تشکیل‌دهنده رسیده است. بر همین اساس، عدم تقارن، اعطای درجه بالایی از آزادی عملکرد به واحدهای محلی، نظام تامین مالی منحصربه‌فرد و طراحی پایین به بالا از مهم‌ترین ویژگی‌های نظام تمرکززدایی در بریتانیا است.

The British Perception of Decentralization

In recent decades, many nationstates have sought to plan or reform the system of devolution and delegation of authority to their local units. Given France’s long history of decentralization, many nationstates follow the French model of decentralization. In Britain, however, a different perception of decentralization has made its legalpolitical structure different from other countries. In this study, we study the decentralization system in the UK. Given the various dimensions of the issue, decentralization in Britain can be seen as the transfer of political and legislative powers, or more accurately, the &devolution& in many local affairs to the constituent units of the United Kingdom. This means that in Britain a different and specific view of decentralization prevails compared to the French model, and the decentralization system in this country goes beyond giving mere administrative and executive decisionmaking authority to local units and reach to devolving legislative competence in local affairs to constituent units. Accordingly, asymmetry, the granting of a high degree of freedom of action to local units, a unique financing system and a bottomup design are among the most important features of the decentralization system in the UK
