چکیده
|
پیدایش مناطق آزاد تجاریصنعتی در سال 1372 در نظام قانونی جمهوری اسلامی ایران موجبات بروز تحول در ساختار دولتکشور در ایران را فراهم کرد. مهم‌ترین اثر ظهور این مناطق در ساختار دولتکشور ایران، خدشه به «وحدت قانون» و «وحدت مقنن» به عنوان دو اصل پذیرفته شده در نظام سیاسی و اداری ایران بود. این پژوهش در قالب مطالعاتی توصیفی–تحلیلی، ضمن تبیین اجمالی تحولات ساختار دولت–کشور در ایران، پیدایش مناطق آزاد تجاریصنعتی در نظام قانونی جمهوری اسلامی ایران را موجب بروز تحول در ساختار دولت–کشور ایران دانسته است؛ به گونه‌ای که در اثر این تحول، ساختار دولتکشور در ایران به سمت الگویی متفاوت از «وحدت انضمامی» و «منطقه‌گرایی» سوق پیدا کرده که از آن به عنوان «وحدت انتزاعی» یاد شد. این در حالی است که مبتنی بر بررسی‌های صورت گرفته در این تحقیق، به‌کارگیری این الگو در نظام حقوقی ایران، با «اصول تبیینکننده ساختار نظام اداری ایران»، «اصول مربوط به وحدت و تمامیت ارضی کشور» و «اصل عدم تفویض قانونگذاری» مغایر است.

Transformation of the State Structure in Iran in the Light of the Emergence of Free Trade-Industrial Zones

Abstract
|
The emergence of free tradeindustrial zones in 1993 in the legal system of the Islamic Republic of Iran caused a change in the structure of governmentcountry in Iran. The most important effect of the emergence of these regions in the structure of the Iranian state was the damage to &unity of law& and &legislative unity& as two principles accepted in the political and administrative system of Iran. This study in the form of descriptiveanalytical studies, while briefly explaining the changes in the structure of governmentcountry in Iran, the emergence of free tradeindustrial zones in the legal system of the Islamic Republic of Iran has caused changes in the structure of governmentcountry in Iran; As a result of this change, the statecountry structure in Iran has shifted to a different model of &concrete unity& and ®ionalism&, which was referred to as &abstract unity&. However, based on the studies conducted in this study, the application of this model in the Iranian legal system is contrary to the &principles explaining the structure of the Iranian administrative system&, &principles related to the territorial integrity and territorial integrity of the country& and &principle of nondelegation&.
