حکم حکومتی و مصلحت عمومی

یکی از مباحث مهم در حوزه حقوق عمومی و فقه سیاسی، تبیین گستره حکم حکومتی و مبنای موجهه‌ساز صدور آن است. که بر اساس مطالعات صورت‌ گرفته به نظر می‌رسد صدور حکم حکومتی به عنوان راهکاری اساسی برای حل معضلات و پدیده‌های نو ظهور سیاسی و اجتماعی در اختیار حاکم جامع‌الشرایط قرارداده شده است تا در شرایط مختلف بر اساس مقتضیات جامعه و در راستای اداره امورکشور، تصمیم متناسب را اتخاذ نماید. این تصمیم البته به نوبه خود نیازمند توجیه است. مصلحت عمومی به عنوان منفعت مشترک تمام افراد به مثابه اعضای جامعه همان مبنایی است که صدور حکم حکومتی بر مدار آن صورت پذیرفته و توجیه می‌گردد. از این روست که نمی‌توان و نباید حکم حکومتیِ صادره بر مبنای مقتضیات روز جامعه و منافع واقعی یکایک اعضای آن را به حوزه مباحات محدود دانست.
