سیاست‌گذاری ‌قضایی جمهوری اسلامی ایران در مواجهه با تهدید فساد اقتصادی(با محوریت پیشگیری و شفافیت)

فساد اقتصادی، از جمله تهدیداتی است که برای کشورها و دولت‌ها وجود داشته و نوعی بدبینی در افکار عمومی دارد، تدابیر پیشگیرانه و ایجاد شفافیت بخشی از اعتماد را جبران نمود. اتخاذ سیاست های کیفری و مجازات مجرمین یکی از مهمترین اقدام دولت ها در طول تاریخ بوده است. در سیاست‌قضایی جمهوری‌اسلامی ایران به پیشگیری و شفافیت تاکید ویژه شده و در سند تحول آمده است، از جمله ویژگی قضات ، محاکم ویژه، تعدد قضات و ... . ابلاغ مواجهه انقلاب اسلامی ایران با جنگ اقتصادی و تحریم از سوی دشمن ‌به عنوان تاکتیک کوتاه‌مدت و راهبرد بلندمدت نظام اقتصادی‌ کشور توسط رهبرمعظم انقلاب، بر اهمیت این تحقیق افزوده است. این پژوهش درصدد آن است که سیاست‌گذاری ‌قضایی جمهوری اسلامی را در مواجهه با تهدید فساد اقتصادی با محوریت پیشگیری- شفافیت بررسی نماید. روش انجام پژوهش به صورت کتابخانه‌ای، اسنادی و با بررسی کتب، پژوهش‌های انجام شده، پایان‌نامه‌ها، مقاله‌های مرتبط می‌باشد. سوال اصلی این است که تاثیر شفافیت - پیشگیری سیاست قضایی در مواجهه با فساد اقتصادی چگونه است؟ نتایج پژوهش بیانگر آن است که با بهره‌گیری از روش‌های پیشگیرانه همچنین شفافیت‌های پیش‌بینی شده در قانون و رفع تعارض منافع می‌توان از فساد اقتصادی و تهدیدها کاست.

economic corruption have existed for countries has caused pessimism in public opinion and dissatisfaction. with preventive measures and making financial information available to the public and creating transparency . in the judicial policy of the islamic republic of iran, special emphasis is placed on prevention and transparency, a part of which is included in the reform document, among others, one can refer to the characteristics of judges ... the announcement of iran’s islamic revolution facing economic war and sanctions by the enemy as a short-term tactic and a long-term strategy of the country’s economic system by the supreme leader of the revolution has added to the importance of this research. this research aims to examine the judicial policy of the islamic republic in the face of the threat of economic corruption, focusing on prevention and transparency. the method of conducting research is in the form of library, documents, and by reviewing books, researches, dissertations, and related articles. the main question is, what is the effect of judicial policy transparency-prevention of economic corruption? the results of the research show that by using economic corruption and the threats it creates for the country can be reduced to a large extent.
