جایگاه دانش بشری در اداره نظام اسلامی با توجه به روش‌شناسی تشخیص مصادیق در فقه با تاکید بر آراء امام خمینی(ره)

یکی از مسائل چالش‌برانگیز پس از انقلاب اسلامی، جایگاه دانش بشری و تخصص در اداره نظام اسلامی است؛ برخی مدیریت فقهی را در عرض مدیریت علمی دانسته و در مقابل برخی در نظر گرفتن مصالح جامعه و توجه به تجربه بشری را به منزله عرفی شدن دین در نظر گرفته و تجربه جمهوری اسلامی را نمونه عینی عرفی شدن حکومت تلقی می‌کنند. هدف این مقاله تبیین جایگاه تخصص در اداره نظام اسلامی بر اساس مبانی فقها مخصوصا امام خمینی(ره) بوده و مدعای این مقاله این است که با توجه به مبانی علما مخصوصا امام خمینی(ره) در رابطه با سنخ‌های مختلف مصادیق موضوعات احکام شرعی، مدیریت فقهی در عرض مدیریت علمی نبوده و مراجعه به عقل و تجربه بشری در اداره جامعه اسلامی، به معنای عرفی شدن دین نیز نیست بلکه ضرورت مرحله امتثال احکام شرعی است. برای اثبات این مدعا ابتدا با توصیف آراء اصولی علما در باب مرجع تشخیص مصداق، جایگاه دانش بشری را در این حوزه نشان داده؛ سپس با بررسی حوزه‌های تشخیص مصداق در اداره جامعه اسلامی به تحلیل لوازم این مبانی در اداره نظام اسلامی پرداخته‌ایم.

the position of human knowledge in the administration of the islamic system according to the methodology of jurisprudence with an emphasis on the opinions of imam khomeini (ra)

one of the challenging issues after the islamic revolution is the place of human knowledge and expertise in the administration of the islamic system. some consider jurisprudential management to be in contrast with scientific management, while others consider the consideration of society’s interests and attention to human experience as the secularization of government. the purpose of this article is to explain the position of expertise in the administration of the islamic system based on the methodology of jurisprudence with an emphasis on the opinions of imam khomeini (ra), and the claim of this article is that according to imam khomeini (ra), jurisprudential management is not in contrast with scientific management, and referring to reason and human experience in the administration of islamic society does not mean the secularization of religion, but the necessity of implementation of sharia law.to prove this claim, first by describing the opinions of the scholars of principles of jurisprudence regarding the authority of human knowledge in this field; then, by examining the areas of administration of the islamic society, we have analyzed the essentials of these basics in the administration of the islamic system.
