جامعه مدنی و توسعه حقوق بین الملل

گسترش رفتارهای خلاف عرف و قواعد بین‌المللی از سوی دولت‌ها بعنوان نقش‌آفرینان اصلی حقوق بین الملل و سیاست‌زدگی سازمان‌ملل‌متحد علی‌الخصوص شورای‌امنیت و سایر سازمان‌های بین‌المللی، صلح جهانی را با مخاطره مواجه ساخته‌است، جنگ‌های پایان ناپذیر و متمادی در خاورمیانه، رقابت تسلیحاتی بین قدرت‌های بزرگ جهانی، نسل‌کشی مسلمانان بوسنی، روهینگیا و ایغورها در چین، جنایت‌های مکرر علیه بشریت در آفریقا، تخریب گسترده محیط زیست، رشد فزاینده خشونت علیه اقلیّت‌های قومی و دینی، نقض فاحش و سیستماتیک حقوق بشر در بسیاری از کشورهای جهان، تحریم‌های یک‌جانبه و ... شاهدی بر ناکارآمدی حقوق بین‌الملل وستفالیایی است.امروزه جامعه مدنی‌جهانی، ضرورت زیست بین‌المللی است. در این جهان نوین، نیاز به عبور از مفاهیم پذیرفته شده جهان وستفالی هستیم. یعنی در سیاست جهانی دیگر سامانه‌ای چون یک دولت محلی توان پاسخگویی به نیازهای امروزین انسان‌ها را ندارد و نیاز به بازنگری در حقوق بین‌الملل و پیشنهاد یک پیمان وستفالی نوین که در آن بازیگران غیردولتی جامعه‌جهانی ، دارای قدرت‌های تقنینیاجرایی شوند، یکی از کاربردی‌ترین راه‌چاره برای مقابله با بحران‌های بزرگی‌است . بنابراین؛ آیا جامعه مدنی می‌تواند با نقش آفرینی در حقوق بینالملل، موجب برون رفت از وضعیت فعلی و تعدیل و کنترل کجروی دولت‌ها از قواعد و قوانین حقوقبین‌الملل باشد؟

So; Can civil society play a role in international law, get out of the current situation and adjust and control the deviation of states from the rules and laws of international law?
