حقوق بین‌الملل و بیماری‌های با قابلیت پاندمی (بررسی موردی: کرونا ویروس)

با شیوع بیماری «کرونا» و سپس بحران همه‌گیری آن، اخبار مربوط به این بیماری ویروسی در صدر عموم رسانه‌های جهان قرارگرفته و تبدیل به موضوع مهم روز شد. تا قرن 21 میلادی که موجی از بیماری‌هایی با ویژگی‌های مشابه نظیر «سارس»، «آنفلوانزای خوکی» و «مرس» در مناطقی از جهان گسترش یافت، درکی درخور از موضوعات این‌چنینی وجود نداشت. حقوق بین‌الملل به‌عنوان حقوق حاکم بر جامعه جهانی، وظیفه وضع قواعدی را جهت تنظیم مناسبات فرامرزی میان واحدهای سیاسی عهده‌دار است ولی تعاریف قدیمی از این شاخه از حقوق، باتوجه به توسعه دامنه موضوعات و تابعان آن جامعیت خود را ازدست داده بود لذا دچار تحول گردید. در آثارجدید حقوق بین‌الملل ضوابطی برای تعیین مکلفان جدید مطرح‌شده ولی تاکنون ملاک و ضابطه‌ای برای موضوعات نوظهورآن بیان‌نشده است؛ که موضوع بحث ما دراین پژوهش حول همین موضوع است چراکه به نظرمی‌رسد رسیدن ویروس کرونا به مرحله پاندمی امکان چنین کاری را فراهم ساخته باشد. اصولاً این واقعه به ما نشان داد که باید به تنظیم قواعدی فراتراز حاکمیت کشورها پرداخت که درمواردی نظیراین، نه‌تنها برای کشورها، بلکه برای کلیه بازیگران صحنه بین‌الملل، الزام‌آور تلقی شود؛ همان‌گونه که در برخورد با مسائلی نظیر «حقوق بشر» و «حقوق محیط‌زیست» شاهد چنین توسعه‌ای بوده‌ایم.

Until the 21st century, when a wave of diseases with similar characteristics, such as &SARS&, &swine flu& and &Morse& spread to parts of the world, there was no understanding of such issues. International law, as the governing law of the international community, has the task of establishing rules for the regulation of crossborder relations between political units, but the old definitions of this branch of law had lost their comprehensiveness due to the expansion of the scope of subjects and their subjects. In the new works of international law, criteria have been proposed for the appointment of new obligors, but so far no criteria have been stated for its emerging subjects; This is the subject of our discussion in this study because it seems that the corona virus reaching the pandemic stage has made this possible. Basically, this incident showed us that we need to set rules beyond the sovereignty of countries that in cases like this, are considered mandatory not only for countries, but for all actors on the international stage; As we have seen in the treatment of issues such as &human rights& and &environmental rights&.
