نقش قاعده تعاون بر نیکی در حاکمیت و حکومت اسلامی

انسان‏ها برای ادامه حیات و جلوگیری از هرج و مرج در جامعه ناچار به تعاون با یک-دیگر هستند. خداوند متعال در آیه «تَعَاوَنُوا عَلَى الْبِرِّ وَ التَّقْوَى‏» (مائده(5): 2)؛ در راه نیکى و پرهیزگارى با هم تعاون کنید، قضیه تعاون در جامعه را از جنبه مثبت و انجام اعمال مفید با واژه‏ «برّ» و از جنبه منفی و پرهیز از اعمال خلاف، با واژه «تقوا» بیان کرده است. حکومت اسلامی به عنوان مصداق بارز «بِرّ» و قانون‏مداری، دموکراسی، مشارکت مردمی و... از مصادیق تقوا محسوب می‏شود که تعاون بر آن‌ها واجب و لازم است. بنابراین، آیه فوق با عنوان قاعده «تعاون بر نیکی و تقوا» قابل طرح است که در تمام لایه‏های جامعه اسلامی کاربرد وسیعی دارد. به همین منظور، فقهای عظام در ابواب عاریه، هبه، امر به معروف، ولایت عدول مومنین، لقطه و... از این قاعده بهره جسته‏اند.مقاله حاضر با روش توصیفی تحلیلی به بیان قاعده تعاون و جایگاه آن در حاکمیت و حکومت اسلامی پرداخته و دریافته است که این قاعده شامل مسائل مختلف جامعه و نظام‏های اجتماعی، اقتصادی، فرهنگی و سیاسی؛ از تشکیل حکومت تا حفظ، بقا و اداره آن و هم‎چنین حفظ نظم و قانون‏مداری می‏شود.

The Role of the Maxim ‘Cooperation in Piety’ in Islamic Governance and Government

To survive and have a peaceful life with no turbulence in society, human beings have to make attempts to promote mutual cooperation. In the Holy Quran, Surat al-MÁidah, verse 2, God the Almighty says, “Cooperate in piety and Godwariness…”. This verse clearly states the issue of cooperation in society both from the positive aspect (performing good deeds) which finds its expression in the word ‘piety’ and from negative aspect (avoid doing evil deeds) which is expressed by the word ‘Godwariness’. Islamic government is considered as the typical example of ‘piety’, and legalism, democracy, public participation, etc., are good examples of ‘Godwariness’ all of which necessitate cooperation. The abovementioned verse can be reformulated as the ‘maxim of cooperation in piety and righteousness’ which is widely applicable to all strata of Islamic society. To serve this purpose, great jurisconsults have made use of the maxim in question in all jurisprudential matters such as ‘loan (lending), donation, enjoining the good, authority of just Muslim believers, found articles, and the like.Drawing upon a descriptive-analytic method, the present article has dealt with the explanation of the maxim of cooperation and its position in Islamic governance and government and has found out that the principle in question extends to include various problems of society and social, economic, political and cultural systems ranging from the formation of government, its preservation, survival, administration, to keeping order and legalism.
